The Role of Attorneys in the Mediation Process Mediation is a form of alternative dispute resolution in which a mediator acts as a neutral to guide the opposing parties towards a resolution. In most cases, an attorney serves as the mediator because of their knowledge of the laws pertaining to the issues. In addition to the mediator, an attorney may be hired by either or both parties to represent them. When choosing a skilled attorney who is also trained and experienced at mediation, representation by a lawyer is usually an added expense that is not necessary. Since the mediator is a neutral and does not take sides, they will guide both parties to help them determine what they want most from the process and how they can best reach a resolution.
