  3. From 5 October 2005 the 2003 Act comes into force • MHTs will take decisions in relation to discharge and lifting of ROs • SMs will retain responsibility for suspension of detention; transfer between hospitals and return to prison from hospital; recall from CD

  4. Revised MOP will not be finalised in time for 5 October • Working version will be available on www.scotland.gov.uk/health/mentalhealthdivision • Link via the Forensic Managed Care Network • Fiona Currie will highlight shortly the main changes to the guidance in the MOP

  5. Delay in final version as a result of: • Internal Review published by way of PQ • Mental Welfare Commission Inquiry • Management of Offenders (Scotland) Bill

  6. Amendments to the MOO Bill will: • Extend provisions in sections 9 and 10 to cover information sharing • Similar to S325 of the Criminal Justice Act • Make health authorities liable to draw up memoranda of understanding between agencies

  7. Care Programme Approach • MOO Bill provides focus to build on SWSG16/96, NHS MEL(1995)5 and NHS HDL(2002)8 • Legislative footing for administrative arrangements for assessing and managing risk • Will ensure multi-agency working, sharing of information and support
