”Dr Fridtjof Nansen” had just finished a cruise in Nigerian waters when it entered the territorial waters of Equatorial Guinea on Saturday 26 June 2004 to conduct a cruise for FAO. The vessel had a fishing permit from the Minister of Fisheries in Equatorial Guinea The vessel was flying both the Norwegian and UN flag Cruise in territorial waters of Equatorial Guinea
The vessel was on a CTD station when a small ”Coast Guard” cutter approached ”Dr Fridtjof Nansen”, adressing them via radio in Spanish, a language no one on the bridge understood. The crew therefore responded in English. After a short time the cutter opened fire with small arms, hitting the ”Dr Fridtjof Nansen” Gunfire
The captain, chief engineer and cruise leader was ordered to come over to the coast guard cutter in the MOB-boat and then the vessel was ordered in to the port of Luba Arrest
On arrival armed guards entered the vessel and closed down the radiostation We kept in contact with the crew via their personal cellphones They called us approx every hour to update us on the situation. We did not call them in case an armed guard was close when the phone rang Luba
Captain, chief engineer and cruise leader was taken away and placed in a flat over night We managed to get in touch with the local FAO-rep and he contacted the Minister og fisheries and the both went to Luba from Malabo and during the night an agreement was made with the military authorities and the vessel was released the next day and continued to Duala, Cameroon Luba cont’d
Norway have no diplomatic relations with the country so the communication goes via the national delegations in the UN HQ in New york The government of Equatorial-Guinea is not willing to take any blame for the incident and insists that we should take full responsibility for what happened So far, no progress concerning an apology from them or from us! The aftermath
Try to have someone fluent in the local language or dialect on board Make sure you have name, adress, phone, fax, mobilephone number and e-mail adress to someone in the country who can help if you need local assistance with the authorities ashore. Local agent may not be sufficient. Check if your country has diplomatic relations with the actual country before entering their territorial waters. If you are not able to make these arrangements, reconsider the cruise! Lessons learned
