  2. Why a New law? The Smoke-Free Hawaii Law is designed to protect the health and well-being of people who do not want to be subjected to secondhand smoke.

  3. Support for the Law • 85% of surveyed Hawaii voters support smoke-free workplaces & public places • Medical evidence supports it • 14 other states have passed similar laws • It’s a global trend

  4. Not a Smoking Ban! Smokers may still purchase and use tobacco products in areas other than those designated as smoke-free under the law.

  6. ALTRES Position • Comply with the law • Assist client companies in complying • Provide guidance to Hawaii’s business community

  7. What is the Law? Smoking will no longer be allowed in partially or fully enclosed buildings: • Owned by the state or the counties • Open to the public (including private businesses) • Places of employment(including private homes licensed for care)

  8. What is the Law? Smoking is no longer allowed: • In airports, from cabin to curb • Within 20 feet of doorways, windows and ventilation intakes • In sports arenas, outdoor arenas, stadiums and amphitheaters (in enclosed, partially enclosed and seating areas)

  9. What is the Law? Smoking is no longer allowed in: • Restaurants • Bars & nightclubs • Outdoor and lanai areas of the above

  10. Exceptions to the Law • Hotels/Motels (no more than 20% of rooms) • Written requests in private and semi-private rooms of nursing homes and long-term care facilities • Outdoor areas of employment, except those provided for within the bill • Part of a film production

  11. Business Compliance • Post the required signage • Smoking Prohibited by Law or International “No Smoking” symbol • At every entrance • Clearly visible • Implement “No Smoking” policy • Inform violators they may not smoke on the premises, according to the law

  12. Violations • Businesses • $100 fine for first offense • $200 fine for second offense • $500 for each additional (within one year) • Licenses may be suspended or revoked • Individuals • $50 plus court fees
