LEGAL FRAMEWORK ON E-RES IN ROMANIA 2. PROVISIONS OF GOVERNMENTAL EMERGENCY ORDINANCE no. 57/04.06.2013 3. PRESENT AND FUTURE OF E-RES ANRE CONTENT
1.1LEGAL FRAMEWORK ON E-RES IN ROMANIA ANRE • Decision of the European Commission no. 4938/2011 – State Aid SA. 33134 2011/N – RO Green Certificates for electricity promotion from renewable energy sources.
1.2LEGAL FRAMEWORK ON E-RES IN ROMANIA ANRE • The Law no. 220/2008 establishing the promotion system of energy produced from renewable energy sources - trading of green certificates (GC) combined with mandatory quota system; • Law no. 139/2010on the amendment and supplementation of the Law no. 220/2008; • Governmental Emergency Decision no. 88/12.10.2011 - updating the Law 220/2008 to fulfil the requirements of the EC Decision no. 4938/2011; • Law no. 134/2012 – for the approval of the Governmental Emergency Decision no. 88/2011 on the amendment and supplementation of the Law no. 220/2008; • Governmental Emergency Ordinance no. 57/04.06.2013 – updates the Law no. 220/2008 to stop the uncontrolled increase of the price to final consumers; • Governmental Emergency Ordinance no. 79/04.06.2013 on the amendment and supplementation of the Law no. 138/2004 on territorial improvement– updates the Law no. 220/2008.
ANRE 1.3 LEGAL FRAMEWORK ON E-RES IN ROMANIA • 1 GC for landfill gas and sewage treatment plant gas; • 2 GC for all types of biomass – residues; • 3 GC for biomass from energy crops and forestry residues.
1.4 NATIONAL TARGETS ON E-RES ANRE National E-RES targets and supported E*-RES quotas per year in the final gross energy/electricity consumption 24% 35% 38% 33% 20% * Supported E-RES in 2011 – 2.5%; 2012 – 5.6% ; 2013 – 11 - 13%
1.5 LEGAL FRAMEWORK ON E-RES IN ROMANIA Order 42/2011 – Regulation regarding to the accreditation of the E-RES producers for the support scheme Order 43/2011 – Regulation for issuing Green Certificates (GC) Order 57/2013 – Regulation regarding to the organization and operation of the GC market Order 45/2011– Methodology for establishing the annual GC quota Order 6/2012– Methodology for monitoring of the support scheme ANRE
ANRE 2. PROVISIONS OF GOVERNMENTAL EMERGENCY ORDINANCE no. 57/04.06.2013 • Postponing 1 GC for wind, 1 GC for new hydro and 2 GC for solar by Jan 01, 2018, respectively April 01, 2017 – Gradual recovery until December 31, 2020; b)* Photovoltaic plants installed on fields registered for agricultural purposes at December 31, 2013 do not receive GC; • Electricity delivered supplementary over notifications sent to TSO, do not receive GC; • GC are issued from the day of Accreditation; • Quotas of electricity consumption may not pay GC; f) GC trade accepted between E-RES producers and suppliers of final consumers, only on OPCOM platform – transparent, centralized and non discriminatory transactions; g) Guaranties for connection; i) Governmental Decision to establish the maximum annual capacities accredited for the support scheme etc.

3.2 PRESENT AND FUTURE ANRE How to mitigate the impact of E-RES on consumer price without jeopardising achievement of EU targets? 3300 MW 2900 MW
ANRE 3.3 PRESENT AND FUTURE • The growth of the investments in E-RES production leads to the compliance with national quotas of E-RES; • The growth of E-RES support scheme has an increasing impact on the consumer’s final price until the electricity target is reached; • Possible unbalance and over-supply between E-RES capacity and national grid.
ANRE 3.4 PRESENT AND FUTURE The ANRE monitoring activity in 2012 regarding to the GCs support scheme, according to Methodology of monitoring electricity produced from RES(ANRE’ Order no. 6/2012)concluded the occurrence of overcompensation for wind, new hydro and solar plants; • According to the conclusions of the Report, the number of GC must be decreased for new entrants to the scheme: • Promotion of the Governmental Decision to implement the conclusions of the Report
ANRE 3.5 PRESENT AND FUTURE • Implementing the Methodology for setting up regulated prices and trading rules for the electricity produced from renewable energy sources in power plants with an installed capacity up to 1MW or 2MW for high-efficiency cogeneration from biomass, when CE authorization
