Are e-cigarettes illegal?Is their use restricted? • Federal law – The FDA does not currently regulate e-cigarettes. • California law - prohibits the sale of e-cigarettes to minors. • Proposed State Legislation, which would extend State prohibitions on tobacco use to e-cigarette use, passed in the Senate in May and died in the Assembly. • Contra Costa County law– E-cigs are regulated as tobacco products

No. • California Education Code 48900(h) – allows suspension if a student… (h) Possessed or used tobacco, or products containing tobacco or nicotine products, including, but not limited to, cigarettes, cigars, miniature cigars, clove cigarettes, smokeless tobacco, snuff, chew packets, and betel.

16. MDUSD Policy • High School and Alternative Education students found in violation of the MDUSD tobacco-free policy on any school campus or school related activity will be required to attend the Tobacco Education Group (TEG) intervention program.

17. Model School Board Policy • “The School Board prohibits the use of products containing tobacco and/or nicotine, including, but not limited to, smokeless tobacco, snuff, chew, clove cigarettes, and electronic nicotine delivery systems, such as electronic cigarettes, electronic hookahs, and other vapor emitting devices, with or without nicotine content, that mimic the use of tobacco products any time, in charter school or school district-owned or leased buildings, on school or district property, and in school or district vehicles. However, this section does not prohibit the use or possession of prescription products, or other cessation aids such as nicotine patches or nicotine gum. Student use or possession of such products must conform to laws governing student use and possession of medications on school property.”
