  2. INSTRUCTIONAL GOAL • The purpose of this instruction is to reinforce the responsibilities of law enforcement officers while responding to and investigating a serious personal injury and/or fatal motor vehicle crash.

  3. OBJECTIVES • Define a motor vehicle crash, public way and bodily injury • Identify Maine State Statute involving motor vehicle crashes • Identify the initial officer(s) responsibilities when responding to a motor vehicle crash

  4. OBJECTIVES • List types of evidence at a motor vehicle crash scene & how to document that evidence. • Identify additional resources to aid in the investigation of a motor vehicle crash. • Identify other agencies to be contacted while investigating a serious injury or fatal crash

  5. OBJECTIVES • List the five elements of a reportable traffic crash.

  6. DEFINITION • Reportable Crash – An accident on a public way or place where public traffic may reasonably be anticipated, resulting in bodily injury or death to a person or apparent property damage of $1,000 or more. MRSA 29-A§2251.1

  7. DEFINITION • 5 Elements of A Reportable Crash • Must originate or occur on a public way. • Must be caused by a motor vehicle in motion. • An injury or death occurs. • Must be an unintended event. • Apparent property damage of $1000.00 or more

  8. DEFINITION • Public Way – means a way, owned and maintained by the State, a County or a municipality, over which the general public has a right to pass. MRSA 29-A § 101.59

  9. DEFINITION • Bodily Injury – means physical pain, physical illness or any impairment of physical condition. MRSA 17-A § 2.5

  10. DEFINITION A motor vehicle traffic fatality is any death that is a direct result of injuries received from a motor vehicle traffic accident. The death is assigned to the accident provided that the death takes place within thirty (30) days of the date and time of the accident. (The cause of death is to be assigned by the Medical Examiner in the death certificate)

  11. Reporting Requirements • MRSA 29A §2251 Accident Reports Reporting requirements and who to contact by quickest means • State Police RCC • State Trooper • Sheriffs Dept. Dispatch • Sheriffs Deputy (jurisdiction of crash)

  12. Reporting Requirements • Municipal Dispatch in Municipality where crash occurred • Municipal Officer (jurisdiction of crash)

  13. Who is required to report? • Operator of the involved vehicle • Person acting for the operator • If operator is unknown, the owner of the vehicle having knowledge of the crash

  14. Investigating Officer • Crashes Involving Death or Serious Personal Injury: • Must be investigated by an officer who has met the training standards of a full-time Law Enforcement Officer.

  15. Responding to the Scene • Information regarding the crash: • Number of Vehicles Involved • Injuries • Severity • Number of Injured • Location • Vehicles in the roadway or out of roadway

  19. At the Scene • Witnesses • Must first identify Witnesses • Keep Separated • Do not allow witnesses to leave until name and contact info is obtained • Written statements • Determine the location of witness at the time of the crash

  20. At the Scene • Officers must facilitate the exchange of information between operators and/or persons involved in the crash • Include primary investigator’s name, case number of crash and a contact number for more information

Evidence Collection • Blood Samples for All Operators • Title 29-A §2522 • If there is Probable Cause to believe that death has or will occur, each operator shall submit to a chemical test. • Secretary of State shall suspend for a period of one year the license of a person who fails to submit to a test.

  30. Additional Resources • ERT/Detectives • Requested when crash scene evidence needs to be processed. • Useful for tire impressions. • Helpful with photography. • DNA samples.

Notifications • Medical Examiner • Must be notified in all fatal crashes • District Attorney • Must be called on all fatal/serious PI crashes • Crash Reconstruction Specialist • Serious crashes involving more than one vehicle or single vehicle crashes with prosecution. • Commercial Vehicle Enforcement (if applicable)

Notifications Cont. • US Dept. of Transportation/Federal Motor Carrier Safety Administration • Contact # 622-8358 • Any highway crash involving the death of 5 or more persons • Any commercial vehicle crash involving a fatality, numerous injuries, extensive property damage, fires, or explosions involving hazardous materials • Spectacular or catastrophic major highway crashes • Any crash that might cause a major highway to be closes for two or more hours

Notifications Cont. • Maine DOT • Contact at #624-3339 • All school bus crashes involving death or injury • Any fatal or serious injury crash where road conditions or traffic control devices caused or contributed to the crash • Vehicle/Train Crashes • Truck Crashes involving spills of cargo onto the roadway. • Crashes involving the transportation of hazardous materials

Notifications Cont. • Dept. of Agriculture • Contact at: #287-3841 • Any crash involving damage to a cargo of food produce of any type. • Dept of Environmental Protection • Contact at: #1-800-482-0777 • Any crash involving damage to a cargo of any type of hazardous material that could cause a water or other environmental problem.

  35. Notifications Cont. • Next of Kin • When notification is made to next of kin, document the name and time that the notification was made. • Give next of kin information on how to contact the investigating officer.

  36. Notifications Cont. • Funeral Home • Inquire with the Medical Examiner’s office and family. • M.E. may want to have blood kit go with deceased to funeral home.

  37. Notifications Cont. • Wrecker Company • Specify what type of wrecker is needed for vehicles • Clarify if the wrecker company can keep vehicle(s) in a secure location. • Advise if any special equipment is needed to retrieve vehicles.

  38. Crash Report • Electronic form 13:20 is used to collect and analyze crash data • Report must be submitted electronically to the Chief of the Maine State Police within 5 business days of the crash • This includes fatal crashes

  39. Crash Report • Report must contain: • Sufficiently detailed information to disclose the cause, conditions, persons and vehicles involved. • Information to permit the Secretary of State to determine whether the requirement for proof of financial responsibility is necessary.

  40. Measuring • Purpose of measuring is to document the crash scene so persons unfamiliar with the scene will be able to interpret a diagram and events of the crash.

  41. Measuring • Measuring is required on crash scenes involving death, serious injuries, and extensive property damage. • Measurements are to be placed into the Maine Crash Reporting System (MCRS) report.

  42. Measuring • XY Coordinate System should be used to measure a scene of a crash. • Also known as Baseline Offset. • Establish a good baseline and be consistent with measurements.

  43. Measuring • Take Measurements of: • Roadway • Vehicles at Final Rest • Reference points • Evidence (skid marks, debris) • Victims • Traffic Control Devices

  44. Measuring • Document the Area of Impact • Measure any items that are important to the crash scene • You can never take too many measurements!

  45. Report Writing • File 14-I This will be sent in a teletype format to several departments: State Police Traffic Division Medical Examiners Office Attorney General’s Office Bureau of Motor Vehicles Bureau Highway Safety State Bureau of Identification

  46. Report Writing • Synopsis This section should include a brief explanation of the crash • Persons Involved/Killed Organize the passengers involved under each operator Include injuries and position in vehicle

  47. Report Writing • Details of Investigation • A chronological detailed description of your crash investigation from start to finish. • Dispatch CAD notes may be used to verify dates and times should be attached as an enclosure if used.

  48. Report Writing • Court/Criminal Record-License Status of Involved • Crash History • Physical/Health History • It is important to investigate 24 hours prior to the crash for each operator involved. • This history could assist you in determining causes leading to the crash.

Report Writing • Drug/Alcohol Involvement • An inventory of the vehicle with contents may help you determine if drugs/alcohol are factors in the crash. • Each operator must be tested with a blood test. The test is done primarily for alcohol; if drugs are suspected you must request a separate test based on evidence you collect.

  50. Report Writing • Vehicle Description and Damage • An examination of the vehicles involved is necessary to determine if any defects may have contributed to the crash. • Also, note the damage on the vehicle(s) to help you determine how the crash occurred and what might have caused the injuries to victims.
