Mafia-type association law (law n. 646/1982) • Proposed by Rognoni and La Torre • Passed on the 13th September 1982 • Makes it a crime to be part of a Mafia-type association composed of 3 or more persons • Makes it a crime to be a promoter, leader, or organizer • Applies to the “camorra” and other associations that • use the force of intimidation and threat • to further the aims of the organization

  3. When is an association Mafia type? When its members: • use force or intimidation of the group • are subject to the associative bound of the organization • adhere to the conspiracy of silence (the so-called ‘omerta’)

  4. Objectives of Mafia-type Associations To: • commit crimes • acquire, in a direct or indirect way, the administration or the control of economic activities, concessions, authorizations, contracts and public services • realize criminal profits or advantages for their group • corrupt the electoral process • get votes for their own or for others in public elections

  5. Aggravating circumstances • If the association is armed • If the economic activities controlled by the members are financed in whole or in part by the proceeds of their crimes

  6. Special measures against convicted persons • Seizure and forfeiture of all property having any nexus whatsoever to a crime • Automatic interruption of: - government authorizations and privileges - trade licenses - public water concessions - inscriptions to the book of public contracts of which the condemned was titular
