Policy Development & Research Department (PDRD) Recent Processes Review of Ownership and Control of Broadcasting Services and Existing Commercial Sound Broadcasting Licences • A Findings Document, which will be based on written submissions, oral submissions at the Public Hearings and additional information requested at the hearings by the Councillors, is being compiled. • Findings Document together with policy recommendations will be submitted to Council at the end of April 2003.
Policy Development & Research Department (PDRD) Inquiry into Sports Broadcasting Rights • Findings Document together with policy recommendations will be presented to Council before the end of March 2003. • Position Paper and regulations will be drafted in April 2003. Minister of Communications and the Minister of Sports will be consulted prior to publication in May-June 2003
Policy Development & Research Department (PDRD) Broadcasting Amendment Act, Act 64 of 2002 • State President assented to Act 29 January 2003, Act published on 4 February 2003, proclamation for commencement published 7 March 2003. • Code of Conduct has been published as a regulation in accordance with the Act on 14 February 2003. Error in commencement date of Code of Conduct was rectified by amendment published in GG 25012, Notice No. 723.
Policy Development & Research Department (PDRD) SABC • SABC to apply to ICASA to amend their licences to reflect the restructuring into public and commercial divisions, within 6 months of commencement or conversion. • SABC to submit policies to ICASA within 3 months of conversion date. • SABC to apply for additional regional T.V. Licenses within nine months of the Act commencing.
Policy Development & Research Department (PDRD) • ICASA must as soon as reasonably possible conduct a licensing process for satellite subscription broadcasting services, cable subscription broadcasting services and any other class of licence prescribed by ICASA from time to time. • ICASA must issue recommendations pursuant to a Section 28 Inquiry on whether sections 49 and 50 of the IBA Act are applicable to broadcasting services carrying more than one channel.
