Appeal to Graduate with a Lower Score on a Regents Examination Appeal of SWDs/Appeal of Low Pass • Students Eligible • Cohort eligible to graduate in January 2016 • IDEA • Provisions • 2 exam fails, 1 score = 52-54 • Waiver of assessment requirement in subject area based on local appeal process • Note • May be used in conjunction with the compensatory option

Appeal to Graduate with a Lower Score on a Regents Examination English Language Learners • Students Eligible • ELLs who enter USA grade 9 or above • Provisions • 2 ELA exam fails, ELA score 55-61 • Waiver of assessment requirement in subject area based on local appeal process • Note • May also use Appeal of a Regents exam for 2nd exam (60-64)

  6. Safety Net Option Compensatory • Students Eligible • Cohort 2005-2006 • IDEA • 504 • Declassification – grade 8 and after • Provisions • Pass Math and English (inclusive of low pass – 55+) • Score of 65 on Regents used to compensate for another score of 45-54 • Up to 2 exam compensations

Superintendent Determination of Graduation • Students Eligible • Students eligible to graduate in June 2016 • IDEA • Provisions • Pass the ELA and math with a 55 • Did not meet graduation requirements through use of safety net option or appeal • Must have earned credits and classes required for graduation • Evidence the student participated in the exams • Other evidence the student mastered proficiency level commencement standards • Written request must be made by parent/guardian • Notes • No requirement to “exhaust” safety net/appeal options before implementing Superintendent Determination

Questions and Answers Superintendent Determination of Graduation with a Local Diploma Must a student pass both the ELA and math Regents examinations in order to be eligible for the Superintendent Determination? Yes. A student must have received a minimum score of 55 on both the ELA and math Regents examinations or a successful appeal of a score between 52 and 54 on the ELA and math in order to be eligible for the Superintendent Determination through this process. Does the Superintendent Determination apply to students who have a 504 Accommodation Plan or who have been declassified from special education? No. Only those students with disabilities who have a current individualized education program (IEP) and are receiving special education services can be considered for the Superintendent Determination.
