Overview • Last CFAC review - November 2009 • Were in midst of investigation of injury that occurred on 9-30-09 (re-bar leg break) • 44 corrective actions – all complete • Resulting in significant positive program changes • Contractor performance improved (doing better than industry averages) currently applying for VPP • Construction safety program is performing “Best in Class”
Overview • Workforce up to 250 workers (over 550 processed) • LOB work starting October 2010 additional 150 workers • Work at multiple sites (chilled water, substation) • Environmental issues winding down - risk being retired • Higher risk activities (excavation, steel, concrete) winding down for ring building, less complex for LOB’s • Safety oversight enhanced and now “right sized” for the complexity and size of project
Progress • Many programmatic enhancements & best practices; • Increased use and detail of PHA’s • Increased communications – daily ESH planning mtgs; weekly ESH Mgmt mtgs; monthly ESH group mtgs, schedule and coordination mtgs with ESH • Modified Safety Incentive – workers receive 90% • On site medical provider – NYS trained EMT’s • Occ Med program – 851 compliant • Drug screening, pre-employment and post-incident/cause • Construction safety assessment – contractor and NSLS-II

Safety Incentive • Safety Incentive modified as result of CFAC recommendation and results of poor first period performance. • Originally a one year period based on rates • 9/30/09 incident and low hours resulted in a 100% loss (500K) • Program was not specific on flow down to workers • New program – effective 4/1/10 • Periods reduced to 2 months • Dollars earned on hours worked • Success based on number injuries (DARTs and TRCs) not rates • Directed 90% goes to workers • Workers have been very responsive to new program
Safety Incentive • Results:
On-Site Safety Coverage • Continuous coverage by NSLS-II Construction Safety Engineers and Torcon Safety Manager • full time concrete sub field safety inspection and Torcon addition of full time field safety inspector • Third NSLS-II CSE added • Daily visits by NSLS-II ES&H Manager (increased since accident) • Weekly visits by Lab Construction Safety Engineer (increased since accident) • Periodic visits by NSLS-II Project Director, Assistant Project Director and other NSLS-II & lab management • Weekly visits by BHSO CSE (Increased since accident) added on-site BHSO CSE 3days/wk • Periodic visits by Liberty Mutual and Zurich Insurance • 2 time/week concrete sub Risk Manager site visits • QA/ESH assessor added 10/4/10

Prime Contractor Coordination • Challenges: • Separate PC’s for Ring Building & LOB’s (Torcon/EWH) • Will be working in close proximity • Second prime also has ISB and Chilled water • Consistency of implementation of ESH is important • Control of workers moving between sites must be controlled • Implementation of separate safety incentive programs will be a challenge
Prime Contractor Coordination • Controls • Detailed ESH Plan – uses project template consistency between two contractors • Requirements for Occ Med, on site med, drug testing consistent • Pre-construction meetings held to condition contractors • Prime coordination mtgs- ongoing • Lab oversight coordination with project started (covers LOB’s, Chilled Water and ISB) • Daily ESH plan of day meeting to be established for LOB contractor
Transition from Construction to Operations • Overall Transition to Operations Plan in development; • Facility will be phased in four segments (Linac, Booster, SR and full operations) • Beneficial Occupancy Readiness Evaluation process will be used • Specific NSLS-II BORE Plan in place • Officially turns over sections of facility to allow machine installation • Specific Commissioning plans for “equipment” (Linac, Booster, SR) will be developed • Commissioning strategy and phasing agreed to by BHSO (approval authority) • ARR for each phase • Commissioning SAD/ASE and final SAD/ASE
Summary - Issues • Construction safety is a high risk but has been significantly mitigated • Staffing enhanced to provide adequate coverage of upcoming activities • Coordination of multiple Prime contractors – consistency • On track with turn over from construction to operations (BORE) and commissioning detailed planning underway
