Small Scale Land Use Amendment • The applicant wishes to remove an undeveloped 6.7 acre parcel that is presently part of the Forest Meadows Cemetery and change the land use designation from Institutional to Office. This will permit development of the property in a manner consistent with land uses to the east (across NW 143rd ) and to the south. The parcel would be incorporated into the Jonesville Activity Center and subject to Activity Center standards.

  6. Rezoning Request • If the small-scale land use amendment is approved, then the applicant wishes to rezone the parcel from its present ‘A’ (Agriculture) zoning district to one that implements the Office land use. The ‘AP’ (Administrative/Professional) district allows a variety of office uses consistent with similar development in the area such as professional services and personal services.

  7. Special Use Permit • Lastly, in order to meet minimum acreage requirements, Forest Meadows is requesting to incorporate an adjoining parcel (4305-001-000) into the cemetery proper. This R-1b zoned parcel (Medium Density Land Use) contains a single family residence at the present time. Cemeteries are allowed in all zoning districts by special use permit (404.36 of the ULDC).

  8. Staff Recommendation • Staff recommends that the Planning Commission convene as the Local Planning Agency (LPA) and recommend approval of the requested small scale land use amendment. Staff further recommends that, should a recommendation for approval of the small scale CPA occur, the Commission, acting as the Planning Commission, reconvene and approve the zoning request from A to AP district.

  9. Staff Recommendation • Lastly, staff recommends that the Planning Commission recommend approval of the requested special use permit to incorporate parcel 4305-001 into the Forest Meadows Cemetery.
