Military Powers of Congress Congress shall have the power… • To declare War • To raise and support Armies • To provide and maintain a Navy • To make Rules for the Government and Regulation of the land and naval Forces • To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions

  3. Military Power of the President The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States

  4. War Powers Resolution of 1973 Created in response to Korean and Vietnam “wars.” • The President must report (reasons)to Congress within 48 hours of engaging troops. • Engagement is limited to 60 days without a Congressional extension. • A 30 day extension can be granted to ensure the safe removal of troops. The Resolution has never been enacted by Congress.
