HB 1505 Summary • Amends Section 1002.39, F.S. by: Removing current language stating that a parent must be “dissatisfied with their child’s progress” in order to request a McKay Scholarship

HB 1505 Summary Student has a current individualized educational plan (IEP) developed by the district school board in accordance with the rules of the State Board of Education no later than June 30, 2011
HB 1505 Summary Student is a first-time McKay Scholarship recipient * *students who have previously participated in the program whether through the private or public school option and left the program are excluded from eligibility in HB 1505. These students would have to regain eligibility by meeting public school attendance requirements in the previous year’s October/February public school surveys
HB 1505 Summary Expansion also creates Section 1002.66, F.S. effective 2013-2014 school year to include students who received specialized instruction services under the Voluntary Prekindergarten (VPK) program during the previous school year and have a current IEP

HB 1505 Parent Information If a parent can answer “yes” to the previous three questions, has made application in a timely fashion, and been registered and enrolled timely by their private school, they should receive their first McKay Scholarship payment under HB 1505 on September 1, 2011

HB 1505 Parent Information Since this potential pool of eligible students may have been out of public school in a private or home education setting for up to four years, it’s imperative to collect as much historical data as possible concerning the student
HB 1505 Parent Information Items may include but not be limited to: • A copy of the last district created IEP • A copy of the last district created services plan (SP) • Any recent evaluation results • Copies of recent report cards • Recent student work samples • Documentation of any services provided through private school or any outside provider • Parent/teacher conference notes • Copies of education plans created by private school
HB 1505 Parent Information Once the IEP is developed, the school district will complete a Matrix of Services document and notify the Department of the student’s matrix funding level through the School Choice Web site.

HB 1505 Private School Obligations Be prepared to provide information on: • the student’s present level of performance • any accommodations provided • any services provided (including times and durations) • any recent evaluation results
HB 1505 Private School Obligations If you are a participating scholarship eligible school, you may register and enroll for your newly eligible student(s) any time after June 30, 2011, but no later than August 2, 2011, in order to receive all four scholarship payments Convey to your parents that students eligible under HB 1505 will not receive their first payment until September 1, 2011
HB 1505 District Obligations The district where the student resides is responsible for determining whether the student is an eligible student with a disability, and if so, complete a matrix of services based on a current IEP
HB 1505 District Obligations Districts should review all available information to determine whether the student has been evaluated and found eligible for ESE services
If IEP is current, develop a matrix of services If IEP is outdated, determine if re-evaluation is necessary If student hasn’t been found eligible in Florida, conduct child find by completing an evaluation within the timeline required by Rule 6A-6.0331, FAC HB 1505 District Obligations
HB 1505 District Obligations In all cases, if the student is an eligible student with a disability, an IEP should be developed that reflects the provisions of a free appropriate public education (FAPE) to the student
HB 1505 District Obligations Unlike a services plan for a parentally placed private school student, the IEP must address all of the student’s needs resulting from the disability and reflect all of the special education and related services that would be provided should the student enroll in the district
HB 1505 District Obligations Even though private school representatives are not required participants of an IEP team meeting, please be prepared to provide input either through attendance at the meeting, participation via phone, or providing written input
HB 1505 District Obligations The deadline for developing a current IEP under HB 1505 is June 30, 2011. Strongly encourage your parents to request a current IEP, preferably no later than March 30, 2011
HB 1505 District Obligations Matrix of Services documents must be completed within 30 days of IEP development
HB 1505 District Obligations If the IEP team determines that the student is not a student with a disability, the student must be dismissed and an IEP will not be developed
