Legislation Public Contract Regulations 2006 (as amended) • Applies to all contracts for the supply of goods, services or works, where the total estimated value of that contract equals or exceeds the relevant thresholds: • Supplies - £173,934 • Services - £173,934 • Works - £4,348,350 • The contract must be advertised at EU Level (Official Journal of the European Union). • Contracting Authorities (LA) must apply the general principles of the Public Contracts Regulations 2006 (as amended) at every stage of the process: - Transparency - Fairness - Equality of Treatment - Non Discrimination (this includes positive & negative discrimination.) Remedies Directive 2009 • Increased risk of legal challenge from aggrieved bidders (eg. West Coast Mainline rail franchise)
Local supplier engagement – steps so far Contract values below £85k require 3 quotations. CPRs now state 2 of the 3 quotes should be from local suppliers where appropriate Training in the use of The Chest e-Tendering Portal, increasing suppliers’ visibility of Council tenders Closer working with Council’s Partnership & Business Development Team Also where appropriate: Use of trials for local suppliers Mail-shots for up-coming contracts Soft market testing Supplier days
