  17. Victim Assistance, Protection & Rehabilitation • Extension of stay in Pakistan for a period deemed necessary by the court. • Payment of compensation and expenses • Arrangements for shelter, food and medical treatment by the government specially for child or destitute woman. (Section 6)

  18. Victim Assistance, Protection & Rehabilitation(HTO RULES 2004) • The victim shall be produced before the court for recording his voluntary statement (U/s 164 Cr.P.C) except when victim is not in a position to get statement recorded. (Rule 3 (1)) • Free legal Aid (Rule 6)

  19. Victim Assistance, Protection & Rehabilitation(HTO RULES 2004) • During trial, the statement of the victim shall be recorded at the earliest to save him from further embarrassment. (Rule 7) • Safe repatriation • If repatriation is not possible, the victim would be allowed to get work permit. (Rule 7) • Legal entitlement for NGOs to participate in all activities beneficial for the victim

  20. Special Rules of Evidence • Implicit or explicit consent of the victim of crime is immaterial. [Section 2 (h)] • Payment of any remunerationin lieu of services or labor of the victim shall not be treated as mitigating circumstances while awarding the punishment. [Second Proviso of Section 3 (ii)] • The plea, if any, taken bybiological parentof the child shall not prejudice the commission of offence under clause (iii) of section 3 of the Ordinance.

  22. PERFORMANCE :HUMAN TRAFFICKING REMOVAL FROM WATCH LIST Tier-II “Pakistan has improved its anti-trafficking performance over the reporting period. Most notably, it has increased trafficking-related prosecutions and convictions, strengthened implementation of its 2002 Prevention and Control of Human Trafficking Ordinance, established an Anti-Trafficking Unit (ATU) within the Federal Investigation Agency (FIA).” US STATE DEPARTMENT REPORT JUNE 2005

  23. PERFORMANCE: HUMAN TRAFFICKINGUS PERSPECTIVE “ I want to commend the Government of Pakistan on its steadfast efforts on combating human trafficking. Because of your ministry’s hard work, Pakistan has made significant strides in combating human trafficking over the last year, as the US State Department has noted in the recently released 2006 Trafficking in Persons report.The report highlights Pakistan’s national action plan to combat human trafficking, the creation of an anti-trafficking cell in Ministry of Interior , and lauds Pakistan’s anti trafficking efforts after the October 8th earthquake ” US AMBASSADOR RYAN C.
