Categorical Exclusion Programmatic Agreement • Gives OES authority for preparing Categorical Exclusions (on behalf of FHWA) for projects within the State of Ohio • Approval Process CE 1 – DEC approval CE 2 – DEC & District Planning Administrator CE 3 – DEC, Planning Administrator, OES CE4 – DEC, Planning Administrator, OES,& FHWA Managing the Environmental & Project Development Process

  4. Section 4(f) Programmatic Agreement • Delegates authority to ODOT to determine whether or not Section 4(f) applies to a project • ODOT may approve ‘standard’ categories of Section 4(f) projects Managing the Environmental & Project Development Process

Section 106 Programmatic Agreement • Is ODOT’s Section 106 process – establishes ODOT’s historic preservation review process as mandated by Section 106 of the National Historic Preservation Act • Delegates authority to ODOT to determine whether or not Section 106 applies to a project Establishes • Eliminates need for project by project review by SHPO • All Section 106 reviews processed by OES Managing the Environmental & Project Development Process

  6. Historic Bridge Programmatic Agreement • Agreement establishing Ohio Historic Bridge Inventory • Establishes procedure for periodic updates Managing the Environmental & Project Development Process

Ecological Package Memorandum of Agreement (MOA) • Applies to low level projects (typically highway projects which involve stream crossings, bank stabilization, and/or minor wetland fills) with minimal impacts • Streamlines the coordination process • Applicable only to projects that can be authorized under the US Army Corps of Engineers Nationwide Permit (NWP) Program • MOA Package – generally requiring literature and minor field review to assess impacts to ecological resources Managing the Environmental & Project Development Process

  8. Farmland Protection Memorandum of Understanding (MOU) • Provides blanket clearance with respect to the Farmland Protection Policy Act for federally funded ODOT projects requiring no new R/W or only minor amounts of new R/W • Eliminates necessity for completion of the Farmland Conversion Impact Rating form for these projects Managing the Environmental & Project Development Process

  9. Scenic Rivers Memorandum of Understanding (MOU) • Delegates review authority to ODOT District Staff and ODNR’s Scenic River Managers for minor projects with minimal or no impacts to Scenic Rivers. Managing the Environmental & Project Development Process

Coastal Zone Consistency Certification – Memorandum of Agreement (MOA) • Streamlines the Coastal Zone Consistency Certification process • Allows routine ODOT projects to be considered consistent with ODOT’s Coast Management policies, eliminating need for coordination with Ohio’s Coastal Zone Office • Outlines criteria for projects that are exempt (from consistency) and require coordination during the PDP Managing the Environmental & Project Development Process

Programmatic Consultation Agreement –- Indiana Bat • Establishes consultation requirement for the Indiana bat within the State of Ohio • Forms tiered consultation process allowing informal consultation for projects meeting certain criteria • Seasonal cutting requirements Managing the Environmental & Project Development Process
