  4. Example- Section 17 leave of absence • Through discussions there is a clear division between service users and services on what section 17 leave means and how it is used Service User Professionals

Section 17 leave of absence Legislation • The Mental Health Act ( chapter 21) has clear guidelines on granting and the use of section 17 leave of absence for detained patients • RC can grant for non restricted patients /MOJ, secretary of state for justice to grant for restricted patients • Leave can be granted for specific occasions/or specific or indefinite periods of time • Leave can be an important part of a detained patients care plan and recovery • Benefits of the leave must out way the risks identified to grant the leave • All leave needs to be recorded and reviewed • The RC may revoke the patients leave at any time if they consider it necessary in the interests of the patients health or safety or for the protection of other people, for restricted patients the secretary of state for justice may revoke leave
