  2. Preamble • Unite people • Liberty to all • Justice to all • Defense • Domestic peace • Promote general welfare to people to better themselves

  3. Legislative Branch (Congress) (Article I) • QUALIFICATIONS FOR HOUSE OF REPS: • 25 years old • 7-year residency in U.S. • Must live in the state you represent • 2-year terms • Unlimited • Based on population of state (census every 10 years) • 435 total (1/519,000)

  4. Qualifications for Senate • 30 years old • 9-year residency in U.S. • Must live in the state you represent • 6-year term • Unlimited • 2 per state • 100 total

Powers Delegated to Congress • Officially write and pass laws • Approve cabinet and supreme court Judges (Senate) • Declare war • Coin money • Borrow money • Impose taxes • Regulate trade • Override/approve presidential vetoes • ELASTIC CLAUSE: make decisions that are “necessary and proper” to change with the times (Living Document)

Powers Denied to Congress • Cannot suspend habeas corpus rights: have to bring possible convict to a trial in order that he/she can hear what charges are against them • Cannot punish without a trial (bill of attainder) • Cannot punish for an act that was legal at time but is now illegal (ex post facto law) • Cannot tax exported goods from U.S. • No preference that favors one state over another

  7. Executive Branch (Article II) • 35 years old • Natural Born • 14-year residency • 4-year term • 2-term maximum • Originally, VP was second place vote getter for president • Cabinet all have to fit these qualifications as well because they are legally in line for the presidency

  8. Powers of President • Enforce laws • Veto power • Appoint cabinet and supreme court judges (approval from Senate) • Ask Congress for war to be declared • Command troops in times of war • Make treaties • State of Union Address every year • Write a yearly budget (approval from Congress)

  9. Judicial Branch (Article III) • NO official age or residency requirements • Lifetime appointment until they step down on own or impeached • 9 judges on Supreme Court • Head judge is “Chief Justice” • 3 Levels of Courts: • Initial court hearings • Court of Appeals • Supreme Court

  10. 5 Types of Cases Heard by Federal Courts • Checks constitutionality of laws (Judicial Review) • Involving governmental positions/employees • Representatives from foreign countries • Authorized appealed cases • Cases involving treason
