Monitor disproportionate representation Over and Under Overall, Disability, Suspension and Expulsion, Placement Calculate and report on SPP Indicators #4 Suspension and Expulsion #9 Overall Disproportionality #10 Disproportionality by Disability Requirements in IDEA • Determine which districts are significantly disproportionate • Overall, Disability, Suspension and Expulsion, Placement • Direct them to use 15% of their IDEA grant to address the disproportionality
Monitor • IDEA requires calculations of disproportionate representation related to • Child Find • Disability • Placement • Discipline • If a district is determined to have disproportionate representation, then the SEA must conduct a review of policies, procedures and practices related to • Child Find, Assessment, IEP development, or in the case of discipline • Suspension and Expulsion, Positive Behavior Intervention, Due Process • If noncompliance is identified the SEA must ensure that policies, procedures and practices are corrected • Must be done, regardless of SPP requirements
SPP Indicators 4b, 9 and 10 • SPP requires calculation of disproportionate representation and calculation of the percent of districts whose disproportionate representation is due to inappropriate policies, procedures and practices. • LEA level calculations are reported to the public
Significant Disproportionality • IDEA requires calculations of significant disproportionality related to • Child Find • Disability • Placement • Discipline • District is considered significantly disproportionate if they fail on any one calculation • State has responsibility of determining calculation • Does not have to use the same calculation as for monitoring or the SPP • State must direct district to use 15% of IDEA grant to address disproportionality
Calculation • As of the last SPP we have adopted the E-formula: The E-formula is defined as: E = A + SQRT [A*(100-A)/N] • E = Maximum percentage of the total special education enrollment in a district allowed for a specific ethnic group • A = Percentage of the same ethnic group in general education in the district • N = The total special education enrollment in a district, as defined in E.
An Example – Upper Value E = A + SQRT [A*(100-A)/N] N= Total SPED Enrollment of the District (5,000) 1 E for African Am = 20.8 + SQRT(20.8*(100-20.8)/5,000) = 21.37
An Example – Lower Value E = A - SQRT [A*(100-A)/N] N= Total SPED Enrollment of the District (5,000) 1 E for African Am = 20.8 - SQRT(20.8*(100-20.8)/5,000) = 20.23
