The results of public consultations and the EIA Report must be taken into consideration during the development consent procedure. (Art. 8) The competent authority shall then inform the public of: contents of the decision and any imposed conditions; and the main reasons and considerations upon which the decision is based, including information about the public participation process, and a descriptionof principal measures taken to avoid, reduce and, if possible, offset any major adverse effects. Project sponsors need to inform those commenting, as well as the affected public of how their comments were taken intoaccount.(Env. Policy, Annex 2, Art. 3.8) For its own review, the EBRD summarises public commentsand the report on public consultation. It considers especially: any comments and how they have been addressed by project sponsors; and how the sponsor has addressed the Bank’s requirements for public consultation.(Env. Taking account of EIA in decision-making in accordance with the Espoo Convention The party of origin shall, in the final decision on the proposed activity, take due account of: EIA documentation; and comments received during transboundary consultations during scoping and review of EIA report. (Art. 6.1) The party of origin shall provide the affected party with the final decision on the proposed activity, along with the reasons upon which it is based.(Art. 6.2)
Taking account of EIA in decision-making in accordance with the Aarhus Convention Each party shall ensure due account of the outcome of public participation in the decision.(Art. 6.8) Each party shall ensure that public authorities promptly inform the public when a decision has been taken. The text of the decision, along with the reasons and considerations upon which it is based, needs to be publicly accessible. (Art. 6.9)
