Performance Bonds / Parent Guarantees • Requirement of the Council’s constitution When a Candidate is not a subsidiary of a parent company the following conditions must be satisfied as to whether a Bond is needed: • Where the total value exceeds £500,000, or • Where it is proposed to make stage or other payments in advance of receiving the whole of the subject matter of the Contract, or • Where there is concern about the stability of the supplier regardless of value

  4. Performance Bond - A sum of money (typically 10% of the contract value) lodged by the provider with a third party, typically a bank, to compensate the client for lack of contract performance / de-mobilising incumbent provider and re-tendering. • Parent Guarantee provided by the provider’s immediate parent or other holding company to act as guarantor for the provider’s fulfilment of the contract.

  5. Finance Checks • At PQQ the council will ask for a Financial Evaluation to be completed and uploaded as part of the provider’s response. There is a pass mark of 40%. • At preferred bidder stage, the council will undertake a Dun and Bradstreet financial check to assess the financial risk of the provider as part of their due diligence.

  6. TUPE • TUPE is a matter of law, not choice • A TUPE questionnaire will be issued to existing providers and their responses will form part of the tender pack • The Council are not responsible for the information provided by these organisations • We would recommend interested parties seek their own legal advice regarding TUPE
