North Carolina Real Estate Practices • Written Buyer Agency Agreements are required when Agent represents a Buyer • Offers To Purchase are made in writing – negotiations to final agreement may be verbal and/or in writing • Real Estate Sales Contracts must be in writing to be enforceable • NC uses a “Due Diligence” Sales Contract that allows for cancellation for “any reason or no reason” • Some builders require the use of their own Sales Contract that will differ from the Standard NC form • Earnest Money Deposits and Due Diligence Fees paid to the Seller are negotiable • Customary inspections include Structural/Mechanical, Wood Destroying Insects and Septic Tank (where applicable)
