The handing over procedure: The handing over of the building means that the responsibility for the building officially goes from the contractor to the client Just before completion of the building, the contractor must inform the Client, in writing, of the completion date of the project The Client has then 10 working days to arrange a handing-over meeting from the time of this written notice. Participants in the meeting at building site: Client, architect, main contractor If the Client does not arrange a handing over meeting within the 10 working days, the building is automatically considered handed over!! If there a serious defects in the building, the Client will refuse the handing over of the building Client and architect make a list of defects and gives the contractor time to repair the defects, and a new completion date is given – for a second handing over meeting The contractor will send a new letter on completion of making good the defects, and the Client must arrange a new meeting within 10 working days If the Client is still dissatisfied with the repairs, he can ask the contractor to immediately repair the defects, and if the contractor does not do it, the Client can get some other contractor to repair the defects at the expense of the first contractor (c) Ernest Müller, VIA UC, eml@via.dk
The Handing Over Protocol • During the handing over meeting (at the site), a document called the Handing Over Protocol is written: • All claims of defective work, by the Client, is written here together with comments thereon by the Contractor • It must be stated in the document whether the parties (Client/Contractor) consider the work handed over or not! • The document must be signed by Client and Contractor. The Contractor cannot refuse to sign the protocol even though he is not in agreement with the Client's defects claims – but he can demand that his comments are correctly recorded in the protocol (c) Ernest Müller, VIA UC, eml@via.dk
A good handing over is important because: • The contractor´s risk and maintenance obligation is transferred to the Client • The deadline for sending the contractor´s final certificate ( final payment) is fixed from the handing over date (payment usually happens max. 15 working days after receipt of payment demand) • The 5-year contractor responsibility for defects is calculated from the handing over date • The 5-year supplier responsibility is calculated from the handing over date • The release of the contractor´s performance bond ( is calculated from the handing over date • The 1st and 5th year inspection is calculated from the hand over date (c) Ernest Müller, VIA UC, eml@via.dk
