Lead Certification Rule Federal Rule implemented by EPA Intended to address proper abatement of lead paint Applies to pre-1978 homes and other facilities occupied by children Company offering services must have “firm certification” Company must ensure that at least one certified “renovator” is onsite to provide proper training to workers
What is the city’s role? • Municipalities are not expected to enforce the lead paint rules – that is EPA’s job EXCEPT: • Minn. Stat. § 326B.106, subds. 13 and 14 requires municipalities to verify that licensed contractors also hold a firm certification in order to obtain a building permit for work on pre-1978 homes
What is the city’s role? (cont.) • Municipalities may charge a surcharge fee of up to $5.00 to cover the cost of verifying certification • Same statute that allows surcharge for checking license status • Check can be done online
Looking up certification online • Start at EPA’s web site: www.epa.gov/lead • Open page labeled “Certified renovation, repair and painting firms near you” • Search statewide for Minnesota • Scroll to bottom and select “Show All” • You will now see an alphabetical listing of all certified firms in Minnesota
What if you can’t find them? • Ask to see a copy of the company’s certificate of firm certification • Write the certification number on the permit application • Call EPA’s National Lead Information Clearinghouse at 1-800-424-LEAD (5323) • Call EPA’s Regional office: (312) 886-6003
