  2. EEO Investigations (Closures) • The measure for FY 05 and 06: 50% of complaints filed will be closed within the regulatory time frames. Definitions: A closure is an investigation where the notice of election is sent to the complainant or a case is closed by settlement, withdrawal, or dismissal. Regulatory time frames are under 180 days, unless extended by amendment (360 days) or extension (270 days).

  3. *Data indicatesthis is a decrease of 5% in cases completed within regulatory time frame when compared to 1st quarter.

Informal ADR Measures • For FY 05: 25% of all complainants who contact EEO (for purposes of seeking counseling of filing a complaint) will participate in the ADR process. • For FY 06: 30% of complainants who contact EEO will participate in the ADR process. Definition: EEO contact means an instance where an EEO Counselor or an ADR Intake Officer performs the counseling duties described in Chapter 2 of MD110. This is the same information which is reported in Part One, Section One of 462 report.

  6. *Data indicates an increase in acceptance of ADR by 12% during 2nd Quarter

Formal ADR Measures • For FY 05: ADR is offered to 80% of complainants who file complaints, and of those offered, achieve a 22% participation rate. • For FY 06: ADR is offered to 80% of complainants who file complaints, and of those offered, achieve a 25% participation rate. Definition: Participation means both parties agree to enter an ADR process.

  8. *Data indicates that the number of complainants offered ADR increased by 34% during the 2nd quarter.

  9. *Data indicates that the number of complainants in the formal complaint stage who accepted ADR has increased by 9% during the 2nd quarter.
