WIRAB Section 215(j) Duties • Provide advice to FERC, NERC and WECC regarding: • Standards • Fees • Governance • Any other subjects FERC requests advice on • Criteria for offering advice: • “Just, reasonable, not unduly discriminatory or preferential, and in the public interest.” • FERC may give deference to WIRAB’s advice since it is an advisory body organized on an Interconnection-wide basis

Issued Covered by WIRAB Advice • Advice to FERC on: • Reliability standards, July 25, 2006 • Fees and consolidated budget of NERC, October 6, 2007 • Funding Western Reliability Centers, November 27, 2006 • Proposed approval of reliability standards • Delegation Agreement between WECC and NERC and NERC’s proposed confidentiality rules • Statutory funding of Western Reliability Centers following the Technical Conference, March 12, 2007 • WIRAB submitted advice to NERC one time on February 8, 2007 regarding WECC’s proposed Tier 1 regional reliability standards.

Themes from Past Advice (1) • Support timely implementation of new standards, but RE’s should be given enforcement flexibility • Based on RMS experience, it is optimal to have a trial period for new standards and incomplete standards • FERC should approve regional standards that go beyond NERC standards • WECC’s proposed Tier 1 regional standards are important for grid reliability in the West this summer • Tier 1 standards from RMS and have been field tested • Standards were previously approved by FERC • Reliability Centers are a core element of the West’s plan to maintain grid reliability • Timely implementation of WECC’s strategic initiative for Western RC’s is very important • Desirable features of RC • Interconnection-wide view • Capability of backing up one another • Independence from transmission owners

Themes from Past Advice (2) • WECC-NERC Delegation Agreement should be based on a clearly defined contractual relationship to achieve the deference and delegation intended by Congress in Section 215 • NERC (and WECC’s) activities should promote transparency • For example, Reliability Adequacy Assessments should enable those who can take action to do so • No decision-maker will rely on assessments that are based on confidential information that cannot be reviewed • NERC and WECC assessments must be transparent • Burden of proof should be on those claiming confidentiality • Confidentiality provisions of NERC’s Rules of Procedure will undercut progress being made in the West • NERC rules should comport with Order 890 goals • Standards should have an economic justification
