Employee and Retiree Service Center Guidelines on Return to Work • Form (440-40) distributed in 2009 • Understand there is a need for guidelines for those employees out 5 days or more • Union Contract Language • MCEA – Article 30.B. 2.d (page 67) and 30.C.7.b (page 69) • SEIU – Article 12.B.8.b • MCAAP – Not applicable • Form 430-1 • Personal Illness: Work Evaluation Form from your physician indicating fitness for duty prior to reinstatement from leave must be provided • Overriding Guideline • Fitness for duty and ability to perform the job
Employee and Retiree Service Center Guidelines on Return to Work Ability to return – local decision or central decision? • Central -- sent to ERSC Leave Team • Workers Compensation • Hospital Admission • Surgery • Leave greater than 60 days • Any 440-40 with noted restrictions that are pertinent to the job • Local • Less than 60 days: Any illness that states or implies no restrictions • Less than 60 days: Any illness that states or implies some restriction but not relevant to the job. • Can be on the 440-40 or a physician’s Rx pad
Employee and Retiree Service Center Guidelines on Return to Work • Employee is not permitted to return to work without the form/physician’s statement • OHR and ERSC have agreed to a 24 hour service level agreement (please fax) • Return to work form sent to ERSC Leave Team • Return to work ability determined by Department of Recruitment and Staffing (DRS) • DRS may consult the ERSC Leave Team and/or the Case Management Team
