  3. 0 Federal Law • The Secretary of the Department of Interior shall not approve any project which requires the useof any significant4(f)propertyunless: (1) There is no feasibleand prudentalternative to the use of such land, and; (2) Such project includes all possible planning to minimize harm resulting from such use OR de minimis impact • 23 CFR 774 Categorical Exclusion Training Class

  4. Definition • Section 4(f) protects: • Publicly-owned Parksand Recreation Areas • Publicly-owned Wildlife and Waterfowl Refuges • Publicly or Privately-owned Historic Sites Categorical Exclusion Training Class

  5. 4(f) Determinations • No 4(f) • No Use • Temporary No Use • de minimis • Programmatic Evaluations • Independent Bikeway & Walkway • Historic Bridges • Historic Sites • Parks, Recreation Areas, and Refuges • Net Benefit • Individual Evaluation Categorical Exclusion Training Class

  10. 0 Remarks • For historic sites, only summarize Section 106 coordination for 4(f) effect determinations • List sites within proposed project area • Discuss impacts to identified sites • Include Section 106 effect finding • Discuss 4(f) determination/coordination dates • Reference maps, photos, & SHPO letter • For projects with only a few historic sites and minimal impacts, a short paragraph will be sufficient Categorical Exclusion Training Class

  13. 0 Points to Remember • Section 4(f) applies to all projects receiving USDOT transportation funds • Only OES can issue 4(f) determinations • Verifies that a property meets 4(f) criteria • Ensures consultation with OWJ occurs and that concurrence is received • FHWA provides approval for certain levels Categorical Exclusion Training Class
