  3. Fireworks 2011 • The success of the 2011 fireworks season depends on YOU… • There are a number of people in our community that STILL want ALL fireworks banned • Your understanding and compliance with the law will go a long way to help keep fireworks stands alive in Santa Maria

  4. Fireworks 2011 • COMMUNICATION is the key to a successful 2010 fireworks season… • You must communicate the rules to all of those volunteers that are working in your stand

  5. Fireworks 2011 • In those instances where a stand is closed and the permit to operate is revoked for a violation, the person in charge of the stand AND the sponsoring organization may be issued an Administrative Citation with a fine of up to $1,000 • A criminal citation may also be issued, requiring an appearance in court, a fine and/or jail

  6. Fireworks 2011 • The laws, regulations, and rules we must live by to have a successful 2011 fireworks season • CA Health & Safety Code • Title 19, CA Code of Regulations • Santa Maria Municipal Code • Santa Maria Fire Department Permit Conditions

Fireworks 2011 • Fireworks purchased at a stand within the City of Santa Maria must be used within our City • Have a current City map in your stand to refer to: www.santa-maria.ca.us • A notice must be given to each purchaser detailing the use requirement • Put one in every bag you hand out • Signs must be posted on all sides of the stand detailing the use requirement

  11. Fireworks 2011 • Stand Inspection • Title 19 CCR, Section 991 • Must submit to inspection at any time upon request of Fire personnel or Police Officer • Failure to permit an inspection will result in revocation of the stand’s permit and removal from the program

  12. Fireworks 2011 • Safety instruction to stand workers • Title 19 CCR, Section 991.2 • All persons working in a stand must be instructed on the conditions of the Fire Dept. permit and safety rules

  14. Fireworks 2011 • Smoking • 12510 CA Health & Safety Code • Smoking is not permitted within 50 feet of your stand • A minimum of two (2) “No Smoking” Signs shall be posted on eachside of your stand • One (1) in English • One(1) in Spanish

Fireworks 2011 • Possession, Use, or Under the Influence of Alcohol or Drugs by a person working in a stand • Title 19, CCR, Section 991.5 • No person shall sell, handle or otherwise partake in any activity in a fireworks stand who is in possession of, or under the influence of Alcohol, or Drugs • This includes prescription medicines that impair a person’s ability to safely handle fireworks

  18. Fireworks 2011 • Persons Under 18 are not permitted to be in your stand • 12689 (b) CA Health & Safety Code • No person under the age of 18 is permitted to be in your stand for anyreason

  20. Fireworks 2011 • Sales to a person under 16 years old • 12689 (b) CA Health & Safety Code • No person under the age of 16 is permitted to purchase fireworks • IF IN DOUBT…ASK FOR IDENTIFICATION No Identification…No Sale!!

  22. Fireworks 2011 • Possession of Unregistered Fireworks in a Stand • 12671 CA Health & Safety Code • All fireworks must have a CA State Fire Marshal’s seal • First Violation - Revocation of the stand’s permit and removal from the program

  23. Fireworks 2011 • Maintaining a “Fire Nuisance” or “Fire Hazard” in or near a stand • (parking within 25’ , trash, dry vegetation, etc) • 12510 CA Health & Safety Code • No person shall permit a fire nuisance or fire hazard in or near a stand

Fireworks 2011 • Reporting the Theft of Fireworks • 12616 CA Health & Safety Code • Santa Maria Police Department 928-3781 (non-emergency) • All persons holding a fireworks license/permit shall report any theft of fireworks to the CA State Fire Marshal and the Santa Maria Fire Department within 24 hours of the discovery of the theft

Fireworks 2011 • Fireworks Storage Facility • ALL traffic entering and exiting the storage facilities shall obey all traffic laws. • ALL fireworks transportation vehicles will be expected to follow the flow of traffic and make turns at traffic signals and stop signs (NO CUTTING ACROSS OPPOSING TRAFFIC).

  35. Fireworks 2011 • Fireworks Storage Facility • No smoking is permitted within the storage facility. • No matches, lighters or other open flame devices are permitted within the storage facility.

  36. Fireworks 2011 • Fireworks Storage Facility • Violation of the Storage Facility Rules are a “One Strike Deal”. One violation and your organization is out of the Fireworks Program.

Fireworks 2011 • Illegal Fireworks • The use of illegal fireworks during the July 4th season brings a lot of community attention to the sales of fireworks and your ability to make money for your organization • Police Officers, Fire Inspectors, Park Rangers, and Code Compliance Officers will be out in force this year trying to put a lid on illegal fireworks sales, possession, and use in OUR community

  38. Fireworks 2011 • Illegal Fireworks • Penalties have been enhanced this year for sales, possession and use of illegal fireworks.

Fireworks 2011 • Illegal Fireworks • Administrative Citations will be issued to persons selling, possessing and using illegal fireworks in our community • This is in addition to a criminal citation requiring an appearance in court, fine and/or jail • The Administrative Citation carries a fine of $1,000

Fireworks 2011 • Illegal Fireworks • We need your help in stopping the use of illegal fireworks in OUR community • Report the use of illegal fireworks to the Santa Maria Police Department at 928-3781.
