  2. Resource Conservation and Recovery Act • Subtitle C- Hazardous Waste • Title 40 of the Code Federal Regulations (40 CFR) parts 260 – 279 • WV Code Chapter 22 Article 18 • Legislative Rule Title 33, Series 20 (33CSR20) • The Legislative Rules incorporate by reference the Federal Regulations

  3. Subtitle C- Hazardous Waste • Arguably the most notable provisions of RCRA • Establishes the “cradle to grave” system • Regulates from the point of generation, through transportation, storage, treatment and ultimate disposal • Requires stringent record keeping and reporting

Some terms to consider… • Solid waste – a discarded (abandoned, recycled, inherently waste like) material • Solid, liquid, semisolid or a contained gas • Hazardous waste – a waste with properties that make it dangerous or capable of having a harmful effect on human health or the environment. • It must first be a solid waste to be a hazardous waste.

  6. “Listed” Wastes • Doesn’t require analytical testing or evaluating the waste’s properties. • EPA made lists of specific waste streams or chemicals that they new posed a threat when disposed of. • Four lists

  7. The Lists • F List – spent solvents, electro plating wastes, dioxin bearing wastes, wood preserving wastes (all non-specific sources) • P and U Lists – commercial chemical products (unused, off spec, container and spill residues) • K List – manufacturing process wastes from specific industries or sources

  8. Common RCRA Violations • Failure to complete a waste determination • Container Management • Closed, labeled and dated • Record Keeping • Contingency Plans

  9. More Applicable Regulations • WV Code §22-11 – Water Pollution Control Act • WV Code §22-12 – Groundwater Protection Act • WV Code §22-15 – Solid Waste Management Act • WV Code §22-30 – Aboveground Storage Tank Act
