PERMISSIONS REQUIRED FROM SPCB • Consent to Establish (CTE) for New Project :- Under section 25/26 of the Water (Prevention and Control of Pollution) Act, 1974 & section 21 of the Air (Prevention and Control of Pollution) Act, 1981. • Consent to Operate (CTO) :- Under section 25/26 of the Water (Prevention and Control of Pollution) Act, 1974 & under section 21 of the Air (Prevention and Control of Pollution) Act, 1981.

  4. WHY HOTELS,BANQUET HALLS,CLUBS, RESTAURANTS & LODGES • Based on the revised Classification of Industries by CPCB (2nd Feb, 2019) • Red Category - Hotels, restaurants, clubs, lodges having overall waste water generation @ 100 KLD and more. • Orange Category – Hotels (< 3 Star) or Hotels having > 20 rooms but less than 100 rooms & having a coal / oil fired boiler. • Green Category – Hotels ( up to 20 rooms), without boilers, overall waste water generation is less than 10 KLD & no hazardous waste generation. http://cpcb.nic.in/uploads/Latest_Final_Directions.pdf

  6. GRANT OF CTE / CTO • Visit the website of the single window https://advantage.jharkhand.gov.in/SingleWindow/ • Apply with fees and required documents

  7. GRANT OF CTE/CTO Fill in the Required Information • Basic information about industry • Occupier details. • Product Details. • Water Emission/ Discharge details. • Air Emission details. • Fee details. • Other relevant details.

  8. GRANT OF CTE/CTO CHECKLIST OF DOCUMENTS TO BE UPLOADED FOR CTE • Authorization to file application. • Land document • Proposed industry to be shown on village map to the scale with marked battery point. • Estimated project cost including cost of land, building, plant & machinery (without depreciation) duly certified by CA. • Detailed budgetary provision in Project report for environmental management and pollution control measures.

Documents to be uploaded for CTE (contd.) • Process flow diagram and disposal for effluent treatment plant with design details if applicable. • Details of air pollution source and proposed air pollution control measures. • An affidavit declaring that terms and conditions of the board shall be abided by PP. • AAQ analysis reports of the proposed area at three points.

  10. GRANT OF CTE/CTO. CHECKLIST OF DOCUMENTS TO BE UPLOADED FOR CTO • Authorization to file application. • EC copy with compliance report, if applicable. • Copy of CTE and CTO with compliance report. • Copy of authorisation under waste management rules. (whichever applicable). • Details of pollution control devices preferably accompanied with analysis of treated effluent/emission/ solid waste as the case4 may be. • Details of ETP/STP with design if applicable. • Details of air pollution control measures implemented. • Environmental statement. • Details of all sources of emission and fugitive emission and pollution control arrangements at its points.

  11. Documents to be uploaded for CTE (contd.) • Estimated project cost including cost of land, building, plant & machinery (without depreciation) duly certified by CA. • Land documents such as sale deed/registered land lease deed/rent deed. • Latitude and longitude of the unit at four points.

EFFLUENT DISCHARGE CONDITIONS: • For hotels with at least 20 bedrooms General Standards for discharge of effluent • pH - 5.5 - 9.0 • TSS <= 50 mg/l • BOD <= 30 mg/l • O&G <= 10 mg/l • Phosphate as P <= 1mg/l Effluent Treatment Plant(ETP) / Sewage Treatment Plant (STP) for the waste  water generated from Toilets/ Bathrooms etc. including proper Oil and Grease Trap  for the effluent arising from  kitchen

  13. EFFLUENT DISCHARGE CONDITIONS • For hotels with less than 20 bedrooms or a Banquet Hall with minimum floor area of 100m2 or a restaurant with minimum seating capacity of 36 General Standards for discharge of effluent: • pH - 5.5 - 9.0 • TSS <= 100 mg/l • BOD <= 100 mg/l • O&G <= 10 mg/l • Phosphate as P <= 1mg/l

EFFLUENT DISCHARGE CONDITIONS: • If, the effluent is discharged into a municipal sewer leading to a Sewage Treatment Plant, the hotel or restaurant or banquet hall, as the case may be, shall provide a proper oil and grease trap for effluent arising from its kitchen and laundry and shall have to comply with the “General Standards for Discharge of Environmental Pollutants Part – A: Effluents” notified under Schedule – VI” • Moeff&cc Notification dated 4th November, 2009 G.S.R. 794(E)

  15. Important Conditions: CTE, CTO or Renewal. • CGWB/SGWD approved Rain Water Harvesting – cum – ground water recharge. • Submit Environmental Statement every year before 30th sept. • Make arrangements for composting of kitchen waste and MSW. • Submit compliance report of CTO conditions every year to the board.

  16. PENALTY FOR NON COMPLYING HOTELS AND ALLIED INDUSTRIAL UNITS • Penalty under The Environment Protection Act, 1986 :- As per Section-15, sub-section-1 :- Be punishable with imprisonment for a term which may extend to five years or with fine which may extend to one lakh rupees, or with both, and in case the failure or contravention continues, with additional fine which may extend to five thousand rupees for every day during which such failure or contravention continues after the conviction for the first such failure or contravention.

  17. PENALTY FOR NON COMPLYING HOTELS AND ALLIED INDUSTRIAL UNITS As per Section-15, sub-section-2 :- If the failure or contravention referred to in sub-section (1) continues beyond a period of one year after the date of conviction, the offender shall be punishable with imprisonment for a term which may extend to seven years. • Environmental Compensation :- A Environmental Compensation will be imposed by JSPCB from the non complying units as per the Hon’ble National Green Tribunal (NGT) directions.
