MC Vote: Employment Law Issue • ISO found that provision in Information Policy conflicts with National Labor Relations Board (NLRB) guidance • Information Policy defines “information related to job status or performance or terms of employment of any ISO employee” as Confidential Information • Intent of provision is to protect information about individual employees from disclosure outside ISO • Possible implication – prohibit employees from discussing this information among themselves • June 2005 NLRB decision found that this type of confidential provision violated the National Labor Relations Act Recommend that the NPC approve ISO’s recommended changes to sections 2.1 and 3.0 of the Information Policy Recommendation
Recommendation to MC: Formal Appeal Process Issue • ISO Information Officer to track information requests & alert affected Parties when Formal Information Request has been made • Any appeal of ISO’s action regarding Formal Information Request subject to binding arbitration with FERC’s Alternative Dispute Resolution Service • Arbitrator to be selected & hearing scheduled within 30 days of Notice of Appeal • Duration of hearing limited to one day Recommend that the NPC approve ISO’s recommended changes to section 3.1 of the Information Policy. Recommendation
Bid Data Issue Scope Change • During the May MC meeting, the IPWG was asked to examine the “bid data” issue, including two questions: • Should the bid data lag period be reduced from 6 months to something less? • Should the bid data be unmasked? • IPWG Deliberations • DBH memo on how addressed in other jurisdictions • Lisa Fink discussion with FERC staff person & report to IPWG • Bid Data subgroup met & developed proposed plan
Bid Data Issue Scope Change • Bid Data Sub-Group proposal • Present release date of 6 months post activities be reduced to three (3) months & ISO release daily (through the website) those units on maintenance or not in the bid stack for the day in a manner as performed within CALISO. • Recommend that the ISO eliminate present masking of participant names when data is released. • MC Chair & Vice Chair, &IPWG Chair believe the daily release of units on maintenance or not in the bid stack is beyond original scope • As such, seeking MC input on the issue before further IPWG consideration Should the IPWG consider the request for daily generation outage information as part of bid data issue, as a separate issue or not at all?
