Maintenance – From JAA to EASA • EU Regulation 1592/2002 defines, (amongst others): Certification of : - product - (Technical) personnel - Organisations • Continued Airworthiness including Certificate of Airworthiness for commercial and non-commercial used aircraft (in accordance to the Annex II) • are falling under the Competence of the European Aviation Safety Agency (EASA) • from the 28th September 2003 onwards (other fields will follow)

Maintenance – From JAA to EASA • JAR’s had to be converted into EC legislative framework For Maintenance: • JAR-145 Implementing Rule ECAR 145 (European Civil Aviation Requirement) • JAR-66 Implementing rule ECAR 66 • JAR-147 Implementing rule ECAR 147 • Continued Implementing rule ECAR-M Airworthiness

  4. Maintenance – From JAA to EASA • EC legislative framework (in general): 1. EC-Regulation (binding for Member States) 2. Implementing Rule (binding) • Part A: Technical part (binding) • Part B: Procedures (binding) • AMC, Guidance Material (not binding) • Formation of Core groups: 5-7 NAA-experts under the leadership of a focal-point-expert.

  5. Maintenance – From JAA to EASA • For Maintenance: 3 core groups with the focal-point from the Central JAA-Maintenance Division. • Core group 145 • Core group 66/147 • Core group ECAR-M

Maintenance – From JAA to EASA Proposals from the core groups delivered February 2003 for EC legal review • After legal review EC will publish the drafts for comments • Comments reviewed by Experts and if appropriate incorporated in the Implementing Rule • Rule will be published on … (28th September 2003)

Maintenance – From JAA to EASA JAR-145ECAR 145 Part A: • No reference to aircraft used for commercial air transport, • No reference to Bilaterals • Some AMC-material is upgraded into the rule • TGL 5, 6, 9, 10,11, 38, 42, 43, 44 are incorporated in the rule • Some requirements out of JAR-66 - related to exercising certification privileges - are transferred into ECAR 145 Part B: Applicable of the Administrative & Guidance Material Section Two: Maintenance Part Two: Procedures Drafts were discussed at Maintenance - Sectorial - Team meetings and are published on the JAA-website.

Maintenance – From JAA to EASA JAR-66ECAR 66 Part A: • Some certification requirement are transferred into ECAR 145 • Incorporation for coverage of Light Aircraft (airplanes < 5700 kg, Helicopters < 3175 kg MTOW) • Including possibility to work outside an approved organisation • Introducing a requirement for continuing experience (ICAO Annex 1) • Incorporation of TGL’s Part B: Applicable Text of the Administrative & Guidance Material Section Two: Maintenance Part Two: Procedures Drafts were discussed at Maintenance - Sectorial - Team meetings and are published on the JAA-website.

Maintenance – From JAA to EASA JAR-147ECAR 147 Part A: • Including the requirements to cover Light Aircrafts Part B: Applicable Text of the Administrative & Guidance Material Section Two: Maintenance Part Two: Procedures Drafts were discussed in the Maintenance - Sectorial –Team meetings and are published on the JAA-website.

Maintenance – From JAA to EASA JAR-OPS 1, 3 Subpart M, Draft JAR-Maintenance ECAR M Continued Airworthiness Requirement for aircraft (defined EC1592/2002): • Transfer of JAR-OPS Subpart M • Incorporation of non-commercial used aircraft • Incorporation of Certificate of Airworthiness continued validity

Maintenance – From JAA to EASA JAR-OPS 1, 3 Subpart M, Draft JAR-Maintenance ECAR M Part A, ECAR-M subparts : • General • Accountability • Maintenance standards • Components • F1- Maintenance Organisation • Continued Airworthiness Management Organisation • Certificate of Release to Service • Continued validity of a Certificate of Airworthiness • Revocation

Maintenance – From JAA to EASA JAR-OPS 1, 3 Subpart M Draft JAR-Maintenance ECAR M • Part B: Administrative procedure new defined or, if relevant transferred from JAA Administrative & Guidance Material Section Two: Maintenance Part Two: Procedures. • ECAR-M proposals were discussed at the Maintenance - Sectorial –Teams meetings • Were presented to : Regulation Sectorial Team Certification Sectorial Team Operation Sectorial Team • ECAR-M draft presented and discussed in 14 presentations in different JAA-Member States with all interested parties. • ECAR-M drafts are published on the JAA-website.

  13. Maintenance – From JAA to EASA Maintenance Bilateral Agreements • Existing Bilaterals are valid until a new agreement is reached • Accepted Organisations will be administrated by the JAA/(EASA) Foreign Maintenance Organisations • Transfer of existing approvals from JAA/NAAs to EASA • Approval of organisations by EASA
