JAA rulemaking process in transition • Derived from FUJA report – EASA takes over CJAA tasks relating to rulemakingin 2007 • Rulemaking procedure for ‘JAA in transition’ agreed (adjusts JAR 11 process) • JAA Rulemaking Programme developed based on JAA Business Plan 2007/08 – EASA (R) and JAAC/ JAAT agreement JAA RST - Cologne

  4. JAA rulemaking process in transition • Document agreed by EASA and JAA • Detailed procedures identifying roles and responsibilities of EASA (R) and JAA-LO • Maintain Sectorial Team process but adapt JAR-11 to take account of EASA’s role JAA RST - Cologne

JAA rulemaking programme Guiding Principles • Facilitate transitioning from JARs to EC IRs • Avoid duplication of effort • Avoid risk of regulatory inconsistency threatening the pan-European system achieved by JAA • Maximum effort to absorb critical items into EASA FCL.001 and OPS. 001 tasks • Anticipate extension of scope: JAA RST - Cologne

JAA rulemaking programme Guiding Principles contd/ • Take account of domains where Community competence is, or is being, established –EU-OPS; development of IRs of the extended Regulation 1592/2002 • EU MS treaty obligation to abstain taking individual or collective action that would affect the independence of Community decisions • Amendments of national rules (incl. JARs) only considered if absolutely necessary and sufficiently consensual to avoid subsequent rejection JAA RST - Cologne

JAA rulemaking programme Execution of tasks: prioritisation • Expedite finalisation of ‘mature’ tasks having a chance of being adopted for integration at same time in JARs and the draft EASA IRs (CAT 1) • Progress work under JAR-11 for tasks that can deliver an input to the draft IRs before the EASA NPA is published (CAT 2) • Stop activities under JAR-11 for tasks not meeting the above criteria: transfer these to EASA advance Planning for 2008 or 2009 (CAT 3) JAA RST - Cologne

JAA rulemaking programme Summary – ‘CAT’ system • Cat 1 – JAR 11 process complete by October • Cat 2 – Mature but not finalised under JAR 11 – may be ‘promoted’ to Cat 1 • Cat 3 – Others: stop activities under the JAA system. Transfer to EASA 2008 or 2009 Advance Planning • New tasks only if urgent and necessary (reasons of safety or ICAO compliance) JAA RST - Cologne

  9. JAA rulemaking programme Implications • Amendments to JARs cease by end of year other than for exceptional / urgent cases • Others processed for adoption of the EASA IRs or their subsequent amendment JAA RST - Cologne

  10. JAA rulemaking programme • JAR-OPS 1 • 10 NPA identified by Air Safety Committee for amendment to EU-OPS • Remainder for OPS.001 or Cat 3 as appropriate • JAR-OPS 3 • 1 Cat 1 task – NPA-OPS 38: helicopter performance • Remainder for OPS.001 or Cat 3 as appropriate JAA RST - Cologne

JAA rulemaking programme • JAR-(F) STD • NPAs-STD 11 & 12: Cat 1 • A number of TGLs will continue to be developed and published – also for incorporation into OPS.001 or FCL.001 as AMC • JAR-FCL 1 & 2 • Most are Cat 2 editorial improvement tasks. Should be incorporated into the FCL.001 task JAA RST - Cologne

JAA rulemaking programme • JAR-FCL 3 • NPA-FCL 33 incorporating editorial and latest proposals: Cat 2 task • Opportunity to ‘catch the FCL.001 train’ depending on content of proposals and outcomes of LSST(M) meeting (18 June) • Take account of opinion of the Chair of the FCL.001 MSG JAA RST - Cologne
