  2. Federal Hazmat Law Protect against the risks to life, property, and the environment which are inherent in the transportation of hazardous materials in intrastate, interstate, and foreign commerce. 49 U.S.C. Section 5101 et seq. U.S. Senate Photo

  3. Hazardous Materials Regulations DOT’s HMR Govern the packaging and safe transportation of hazardous materials by air, highway, rail, and water (except bulk transportation onboard vessels).

  4. PHMSA Responsibilities • Formulates, issues and revises, and enforces the HMR • Issues special permits and approvals under the Federal Hazmat Law • Enforces regulations emphasizing: • Packaging Manufacturers, Retesters and Reconditioners • Multimodal shippers of hazmat

  5. Responsibilities (cont’d) • Modal administrations (FAA, FMCSA, and FRA) enforce the HMR respective to their mode • U.S. Coast Guard (Department of Homeland Security) enforces the HMR respective to maritime operations

  6. Who Are Our Customers? • The Public • Hazardous Materials Carriers • Hazardous Materials Shippers • Package Manufacturers, Retesters, and Reconditioners • State and Local Governments • Law Enforcement • Emergency Responders and Planners

  7. Key Cylinder Issues • Is it Commerce? • Is it “Safe” to Transport? • If in Commerce it must meet regulatory requirements. • Process of receiving a Special Permit. • Must be an equivalent level of safety.

  8. Hazardous Materials Safety Assistant Team (HMSAT)

  9. Hazardous Materials Safety Assistance Team Offers: • Informational training and Technical assistance • Act as POC for HAZMAT Transportation Issues. • Conduct preliminary research • Unofficial determinations on transportation issues • Provide training on basic aspects of transporting HAZMAT
