Criminalisation and decriminalisation • Criminalisation refers to how certain acts or omissions are made criminal offences • Decriminalisation refers to how certain acts or omissions are removed from the scope of the law so that they are no longer criminal offences • Criminalisation can also refer to the processes by which certain groups in society are penalised by the criminal law
Social harm • Not all criminal offences cause social harm and not everything that causes social harm is a criminal offence • Should something be illegal if it causes social harm? • Should anything that does not cause social harm be legal? • Is this a useful way to think about crime?
Breaking the law • Many examples in history of social change and progress resulting from people breaking the law • Can obeying the law sometimes cause more social harm than breaking it? • Is it OK to break the law if the law is unfair? • How do you define what is unfair?
