  2. Rape • In 1991, the Victorian Parliament introduced the Crimes (Sexual Offences). • Rape is defined as: Intentionally sexually penetrating another person without that persons consent.

  3. Incest • Incest is sexual intercourse between people who are closely related. • A person who takes part in an act of sexual penetration with a person he or she knows to be his/step child is also guilty of incest. • Incest also includes when a person takes part in an act of sexual penetration with a person under the age of 18yrs whom he/she knows is a child/stepchild of their de facto spouse. • Maximum penalty 25yrs • Sex Offenders Registration Act 2004 (Vic). Pg 51

  4. Indecent assault • Assault is when a person threatens to commit, or does commit some form of physical harm to another person. • The person committing the indecent assault must be aware that the person is not consenting or might not be consenting.
