LOCAL AREAS AND LOCAL GOVERNMENTS COMPOSITION OF LOCAL AREAS For the purpose of this ordinance the following shall be the local areas namely: Union Taluka Town District and citydistrict
DELIMITATION OF UNIONS A union shall be an area comprising one or more dehs or in the case of an area where revision of settlement under the law has not been taken,one or more census villages or in the case of an area with urban characteristics.(the boundaries of a union shall not cross the limit of a taluka,or a town in a city district)
DELIMITATION OF A TALUKAS AND DISTRICTS The government shall,by notification in the official gazette,declare talukas and districts notified under the sindh land revenue act 1967. CREATION OF A CITY DISTRICT The population of urban settlement exceed one million people. The economy is largely oriented to commercial,industrial,and services sector and according to the last preceding census , the labors force employed in such sector or in non-agricultural sector is more than sixty six percent.
LOCAL GOVERNMENTS FOR LOCAL AREAS • District government and zila council in a district. • Taluka municipal administration and taluka council in a taluka. • Town municipal administration and town council in a town. • Union administration and union council in a union.
DISTRICT GOVERNMENT COMPOSITION OF DISTRICT GOVERNMENT The district government shall consist of zila nazim and district administration. The district government shall be component to acquire hold or transfer any property, moveable and am movable to enter into contract and to use in its name through district coordination officer.
AUTHORITY AND RESPONSIBILITY OF DISTRICT GOVERNMENT • The authority of district government shall comprise the management and control of offices of the department which are decentralized to it. • Every order in the district shall be expressed to be made in the name of district government • The district government shall be responsible to the people and the government for improvement of governance and delivery of services.
ZILA NAZIM Zila nazim shall head the district government. Zila nazim shall ensure that the business of district government. FUNCTION ANDPOWERS • Provide vision for the district wide development. • Perform function relating to law and order in the district. • Oversee formulation and execution of the annual development plan.
Present proposal to the zila council for approval of budget. • Maintain administrative and financial discipline. • Present tax proposals to the zila council. • Take charge,organize and prepare for relief activities in disasters or natural climate. • Initiate inspection of taluka administrations. • The zila nazim shall not employ any advisor or a political secretary. • The zila nazim shall have the right to speak in the proceedings of zila council.
RESIGNATION OF ZILA NAZIM The zila nazim may resign from office by tendering resignation in writing addressed to the chief executive of the province. STRUCTURE OF DISTRICTADMINISTRATION The district administration shall comprise the district offices,including sub offices of the departments of the government and other offices.
DISCIPLINARY POWERS OF NAZIMS AND NAIB NAZIMS They shall be empowered to take disciplinary action against local government functionaries of their respective establishments.
ZILA COUNCIL COMPOSITION OF ZILA COUNCIL • A zila council shall consist of all union nazims in the district and following members elected on reserved seats namely: • Number of women so as to represent thirty three percent of the total number of union in the district. • Number of worker so as to represent 5% of the total number of union(minimum of one seat).
FUNCTION AND POWER S • Approved bye laws proposed by the district government. • Approve annual budget of the zila council. • Elect committees of the zila council for monitoring the performance of the district government. • Elect sports and culture committee. • Elect an insaf committee. • Elect a zila accounts committee. • Approve posts for for the office staff of zila nazim. • Review measures for flood relief and storm water drainage.
FUNCTION OF ZILA COUNCIL IN A CITY DISTRICT • Approve masters plans,zoning,land use plans,including classification and reclassification of land,environment control,urban design,urban renewal and ecological balances. • Approve proposals of the district government for public transport and mass transit system
TALUKA AND TOWNMUNICIPAL ADMINISTRATION COMPOSITION OFTULAK AMUNICIPAL In every taluka there shall be a taluka municipal administration which shall be a body corporate and consist of a taluka nazim,tulka municipal officer and over officials of local council.
TOWN MUNICIPAL ADMINISTRATION In every town in a city district shall be a town municipal administration which shall be a body corporate and consist of town nazim,town municipal officer,town officer and other officials of the local council. FUNCTION ANDPOWERS • Prepare spatial plans for the taluka. • Execute and manage development plans. • Enforce all municipal laws.roads and streets • Prevent encroachments. • Regulate affixing of sign-boards and advertise
Water supply and control development. • Sewerage,sewage and sewage treatment and disposal. • Strom water drainage,sanitation and solid waist. • Street lightning,fire fighting,traffic planning. • Parks,play grounds,open spaces and arboriculture,slaughter houses. TALUKA NAZIM Taluka nazim shall head the taluka municipal administration Tulka nazim shall be responsible to ensure that the business of tulka.
FUNCTION AND POWERS • To approve taxes,cuss,rents,fees,user-charges,tools,lives,fines. • To approve bye-laws for delivery of municipal services. • To approve annual budget.To approve long and short term development plan. • To approve land use zoning and master plans.
Union Administrator Composition of Union Administrator There shall be constituted a Union Administration for every Union which shall be a body corporate and consist of Union Nazim, Naib Union Nazim and not more than three Union Secretaries and, where required, the members of ancillary staff. Functions of the Union Administration The functions of Union Administration shall be. • To collect and maintain statistical information for socio economic surveys.
To consolidate village and neighborhood development needs. • Ø To identify deficiencies in the delivery of services. • Ø To register births, deaths and marriages and issue certificates. • Ø To establish and maintain libraries. • Ø To organize inter Village or Neighborhood sports tournaments, fairs shows and other cultural and recreational activities. • Ø To provide and maintain public sources of drinking water, including wells, water pumps, tanks ponds and other works for the supply of water. Ø
Ø To maintain the lighting of streets, public ways and public places through mutual agreement with the Taluka Municipal Administration. • Ø To arrange facilities for the handicapped destitute and poor. Resignation by Union Nazim The Union Nazim may resign from his office by tendering resignation in writing addressed to Naib Zila Nazim
Union Council Composition of the Union Council There shall a Union Council in each Union comprising 1[thirteen] following members elected directly in accordance with section 148. • Ø2[six] Muslim members, elected to general seats, including 2[two] reserved for women; • Ø3[four] members, elected to seats reserved for peasants and workers, including two reserved for women; • One member elected to a seat reserved for minority communities; and
Union Nazim and Naib Union Nazim elected as joint candidates: Functions of the Union Council The functions of the Union Council shall be to • Ø Approve the annual development plan and budgetary proposals of the Union Administration; • Approve rates and fees for services. • Ø Facilitate the formation and functioning of citizen Community Boards. • Ø Mobilize the community involvement in maintenance of public ways, public streets, culverts, bridges and public buildings, de-silting of canals and other development pursuits.
ØPromote plantation of trees landscaping and beautification of public places in the Union. • Ø Approve the terms and conditions of the employment of village or neighborhood guards and oversee their functioning. • Ø Elect a union accounts committee which shall be responsible for examination of the audit reports. • Ø Review the annual statement of accounts and external.
Local government finance Establishment of Funds and Public Accounts (1) There shall be established a District Fund, a 2[Taluka Local Fund, Town Local Fund and Union Local Fund] as the case may be, for each respective Local Government. (2) All revenues received by a Local Government shall form part of the respective Local Government Fund including.
Ø Monies transferred by another Local Government under this ordinance; Grants made to or monies received by a Local Government from the Government or other sources. • Ø The proceeds of taxes or charges levied by a Local Government under this Ordinance; • Ø Gifts, grants or contributions to a Local Government by individuals or institutions; • Ø Income accruing from markets or fairs regulated by a Local Government.
(3) All other moneys including • Ø Receipts accruing from trusts administered or managed by a Local Government. • Ø Refundable deposits received by a Local Government and • Ø Deferred liabilities Custody of funds Monies credited to a Fund or a public account shall be kept in the State Bank, government treasury a post office or a bank.
Budget Preparation (1) The annual budget for each Local Government shall contain estimates of: • Ø Grants in aid from the government. • Ø Amounts available in the respective fund; • Ø Receipts for the next year; and • Expenditures to be incurred for the next year. (2)To enable the budget preparation by Local Government the Government shall, sufficiently before the beginning of each financial year, notify the provisional shares.
Approval of Budget (1) Following the presentation of the Provincial budget but, before the commencement of the next financial year, each Nazim shall, present the budget for approval by the respective Council before the beginning of such financial year. (2) When a Local Government assumes office for the first time, it may within ten weeks, present to the respective Council a budget for the remaining part of the financial year for approval.
Local governmentelections Franchise (1) Members of a Union Council including Union Nazim and Naib Union Nazim shall be elected through direct elections based on adult franchise and on the basis of joint electorate. (2) The Electoral College for the election of Zila Nazim and reserved seats of women, peasants and workers and minorities in the Zila Council shall be all the members of Union Councils in the District, including Union Nazims and Naib Union Nazims.
Qualifications for candidates and elected members A person shall qualify to be elected or to hold an elective officer or membership of a local government if he. • ØIs a citizen of Pakistan • Ø Is at least twenty five years of age. • Ø Is enrolled as a voter in the electoral rolls of the relevant ward. • Ø Is of good character and is not commonly known as one who violates Islamic injunctions has adequate knowledge of Islamic teachings and practices.
Ø Has academic qualifications of not less than matriculation or secondary school certificate or equivalent from a recognized institution for contesting the election of a Nazim or Naib Nazim. Ø Has not been declared by a competent court to be of unsound mind. Ø Is not in the service of the Federal a provincial or local government. Ø Has not been adjudged a willful defaulter or any tax. as not been declared an un-discharged insolvent by any court
Elections of Nazims etc (1) A candidate for the office of Zila Nazim and a Taluka Nazim or a Town Nazim securing highest number of votes in their respective wards against other candidates shall be declared elected. (1) 2)(2) A Union Nazim and Naib Nazim as joint candidates securing highest number of votes in their electoral ward against other joint candidates shall be declared elected.
