  9. หลักการของIPPC • ประเทศมีอธิปไตยในการออกกฎหมาย • กำหนดมาตรการเมื่อมีความจำเป็น • หลักการของมาตรการที่กำหนด • ตรงกับความเสี่ยงที่เกิดขึ้น • มีเหตุผลทางวิชาการ • มีความจำกัดน้อยที่สุด • ไม่มีการเลือกปฏิบัติ • มีความโปร่งใส

  10. หลักการของIPPC • จัดตั้งองค์กรอารักขาพืชแห่งชาติ(NPPO) และ Official IPPC contact point • ควบคุมการปฏิบัติ (treatment) รับรองการส่งออก และออกกฎระเบียบการนำเข้า • สร้างความร่วมมือระหว่างประเทศ โดยการแลกเปลี่ยนข้อมูลด้านศัตรูพืชและกฎระเบียบ • จัดทำและพิจารณามาตรฐานระหว่างประเทศด้านสุขอนามัยพืช

  11. วัตถุประสงค์ของ IPPC • ป้องกันการเข้ามาและการแพร่ระบาดของศัตรูพืชและผลิตผลพืชที่มีการเคลื่อนย้ายระหว่างประเทศด้วยความร่วมมือของประเทศภาคี • สนับสนุนการใช้มาตรการที่เหมาะสมในการควบคุมการเข้ามาและการแพร่ระบาดของศัตรูพืช • ปกป้องศัตรูพืชทั้งในสถานที่เก็บรักษา บรรจุภัณฑ์ ยานพาหนะ และวัสดุที่ศัตรูพืชสามารถอาศัยอยู่ได้ • ประเทศภาคีต้องยอมรับมาตรการด้านกฎหมาย ด้านวิชาการ และด้านการบริหารที่กำหนดไว้ในอนุสัญญาฯ

  13. สาระสำคัญของ IPPC ฉบับปี 1997 • 1) ขยายขอบเขตการครอบคลุมทั้งพืชปลูกและพืชป่า • กำหนด regulated pest เป็น quarantine pest และ regulated non-quarantine pest • สร้างมาตรฐานระหว่างประเทศ (ISPMs) • ขยายความรับผิดชอบของ NPPO เช่น การวิเคราะห์ความเสี่ยง การเฝ้าระวังเพื่อรายงานการเกิด การระบาด และการแพร่กระจายของศัตรูพืช • กำหนดมาตรการเกี่ยวกับการนำเข้า regulated articles • ให้ความร่วมมือระหว่างประเทศด้วยการตั้ง Contact point • สนับสนุนให้มีการพัฒนาและใช้ ISPMs ในการกำหนดเป็นมาตรฐานประเทศ

  18. 1992 Established a Secretariat for the IPPC by FAO the Commission on Phytosanitary Measures (CPM) adopt International Standards for Phytosanitary Measures (ISPMs) Regional Plant Protection Organization (RPPO) a coordinating body for National Plant Protection Organizations (NPPO) on a regional level 9 RPPOs:Asia and Pacific Plant Protection Commission (APPPC)Comunidad Andina (CA)Comite de Sanidad Vegetal del Cono Sur (COSAVE)Caribbean Plant Protection Commission (CPPC)European and Mediterranean Plant Protection Organization (EPPO)Inter-African Phytosanitary Council (IAPSC) North American Plant Protection Organization (NAPPO)Organismo Internacional Regional de Sanidad Agropecuaria (OIRSA) Pacific Plant Protection Organization (PPPO). 10th RPPO : Near East Plant Protection Organization (NEPPO) 2 more countries must deposit their ratification to bring NEPPO into force National Plant Protection Organizations (NPPO)

  20. บทบาท Commission on Phytosanitary Measures (CPM) • จัดทำและให้ความเห็นชอบต่อ ISPMs • ตรวจ/ทบทวนสถานภาพของการอารักขาพืช • จัดทำแผนการปฏิบัติงานประจำปี • สนับสนุนให้ความช่วยเหลือด้านวิชาการและการแลกเปลี่ยนข้อมูล • เป็น Government body of IPPC • สมาชิกต้องเป็นประเทศภาคี และตกลงกันด้วยระบบฉันทามติ มีการประชุมปีละ 1 ครั้ง

  21. สำนักเลขาธิการ(The Secretariat for the IPPC) • อยู่ภายใต้ Plant Protection Service ofFAO • ปฏิบัติงานตามแผนงานของ CPM • สนับสนุนการจัดทำ ISPMs และประสานงานกับ RPPOs • เป็นตัวแทนของ CPMในการประชุมระดับนานาประเทศ เช่น WTO-SPS , CBD • อำนวยความสะดวกในการแลกเปลี่ยนข้อมูลและการดำเนินงานต่างๆ ของ CPM

  22. บทบาท Regional Plant Protection Organizations (RPPOs) • จัดทำมาตรฐานระดับภูมิภาค (Regional Standards for Phytosanitary Measures-RSPM) • เป็นผู้ประสานงานระหว่างประเทศสมาชิกในภูมิภาคเดียวกัน ประชุมปีละ 1 ครั้ง • สมาชิกของ RPPOs อาจจะเป็นประเทศภาคีของ IPPC หรือไม่ก็ได้

  23. บทบาทNational Plant Protection Organization (NPPO) • กำหนดรายละเอียดไว้ใน Article 4 ของอนุสัญญา ฯ • ตัวอย่างบทบาทหน้าที่ของ NPPO • รับผิดชอบในการออก Phytosanitary Certificate • จัดทำ Surveillance • ตรวจสอบพืชและผลิตภัณฑ์ที่มีการเคลื่อนย้ายระหว่างประเทศ • ดำเนินการจัดทำ Pest Risk Analysis • ฯลฯ

  26. 4 ขั้นตอนของการจัดทำISPMs • Stage 1: Developing the work program • (1) NPPOs,RPPOs เสนอหัวข้อต่อสำนักเลขาธิการIPPC • (2) CPM พิจารณาหัวข้อที่นำเสนอ จัดลำดับความสำคัญ • (3) CPM บรรจุไว้ในแผนงาน • Stage 2: Drafting • (1) จัดตั้ง Expert working group/Technical panelsเพื่อพิจารณา draft ISPMs • (2) เสนอให้ Standard Committeeพิจารณา

IPPC and International Trade Agreements • (1) Obligations under the IPPC are consistent with and complementary to the WTO-SPS Agreement • (2) Most major trading partners and WTO member are IPPC’s contracting parties • (3) Increasing credibility of national phytosanitary systems for trading partner

  37. IPPC and International Trade Agreements(Cont.) • (4) Participation allows for direct and active input into processes of global harmonization • (5) Opportunities are provided to interact with the WTO-SPS Committee through the phytosanitary community

  38. IPPC and Technical Assistance • (1) increased possibilities for CB and strengthening plant protection infrastructures, • (2) assistance with dispute settlement from the IPPC Secretariat; • (3) assistance with reviewing and updating legislation;

  39. IPPC and Technical Assistance (Cont.) • (4) possibilities for emergency programs through FAO or other organizations; • (5) availability of technical expertise through the IPPC Secretariat; • (6) possibilities for the coordination of technical assistance on a bilateral or multilateral basis .

  40. IPPC and Dispute Resolution • (1) assistance with dispute settlement procedures; • (2) access to a lower profile , non-binding alternative with emphasis on technical dialogue

IPPC and Information Exchange • (1) opportunities to request or to provide official information; • (2) participation in a neutral forum for the provision and exchange of technical information related to plant protection and trade; • (3) assistance to developing countries in information exchange capabilities; • (4) possibilities for training national personnel;

IPPC and Information Exchange (Cont.) • (5) direct access to standards and related information from the IPPC Secretariat; • (6) opportunities to submit discussion papers and other information to working groups; • (7) participation in and benefit from technical meetings on phytosanitary issues.

  45. IPPC and Other Benefits • (1) There are no additional financial obligations. • (2) There are no minimum criteria to which to adhere. • (3) Becoming a contracting party is a simple process of depositing an instrument of adherence with the Director-General of FAO.
