HUB Subcontracting Opportunities Texas Government Code §2161.252 and 34 Texas Administrative Code §20.285 • TGC §2161.252 - Agencies that consider entering into a contract of $100,000 or higher must, determine whether subcontracting opportunities are probable under the contract. This determination must be done before the agency solicits bids. • TAC §20.285 - A respondent (Prime contractor) may demonstrate good faith effort to utilize Texas certified HUBs for its subcontracting opportunities if the total value of the respondent’s subcontracts with Texas certified HUBs meets or exceeds the statewide HUB goal or the agency specific HUB goal, whichever is higher.

HUB Goals The statewide HUB goals defined in 34 Texas Administrative Code (TAC) §20.284: • Special Trade – 32.9% • Professional Services Contracts – 23.7% • Other Services – 26.0% • Commodities – 21.1% Note: TCEQ doesn’t have Heavy Construction (11.2%) nor Building Construction (21.1%) contracts.

Good Faith Efforts (GFE) • GFE 1 – Solicitation Method • Subcontracting any portion of the contract to Texas certified HUB vendors andNon-HUB vendorsoronly to Non-HUB vendors. • GFE 2 – Active HUB • Subcontracting all work to onlyTexas certified HUB vendors. • GFE 3 – Meeting/Exceeding HUB Goal • Subcontracting any portion of the contract to Texas certified HUB vendors and Non-HUB vendors. • The percentage of all the subcontracting work to the Texas certified HUB vendors can only be with those that you do not have a continuous contract* in place for more than five (5) yearswill meet or exceed the agency or State HUB goals. *Any existing written agreement (including any renewals that are exercised) between a prime contractor and a HUB vendor, where the HUB vendor provides the prime contractor with goods or service, to include under the same contract for a specified period of time. Two or more contracts that run concurrently or overlap one another for different periods of time are considered by CPA to be individual contracts rather than renewals or extensions to the original contract.

  6. HUB Subcontracting Plan (HSP) In accordance with Texas Gov’t Code §2161.252, the contracting agency has determined that subcontracting opportunities are probable under this contract. Therefore, all respondents submitting a bid, including State of Texas certified Historically Underutilized Businesses (HUBs) must complete and submit the State of Texas HUB Subcontracting Plan (HSP) with their response to the bid requisition (solicitation). • All respondents submitting a bid must submit a complete HUB Subcontracting Plan (HSP) to be a responsive bid. • HSP Form Location: • https://comptroller.texas.gov/purchasing/vendor/hub/forms.php • Responses that do not include a completed HSP will be rejected.

Notification of Subcontracting Opportunity to three Active HUBs and two Minority/Women Owned Trade Organizations – Provide Email notifications and CMBL Profiles (Active HUBs). • Provide copies of email notifications (deadline listed) • Provide copies of all Active HUBs CMBL Vendor Profiles.

  9. GFE 1 – Solicitation Method – HSP Attachment B cont. • Reminders: • Send email notifications to a minimum of 3 active HUBs (from the CMBL) and a minimum of 2 Minority/Women Own Businesses. Provide the “7 working days deadline” for their responses. • Keep a copy of the submitted email notifications and submit with the HSP. • Provide all active HUBs CMBL Profiles with the HSP.

Subcontractor(s) Selection • Provide the VID or Federal ID (do not enter SS#), HUB status, approximate dollar amount and/or expected percentage of the contract. • Submit copies of all Active HUBs CMBL Vendor Profiles. Note: You must repeat these steps (1 – 4) for each subcontracting opportunity.

Subcontractor(s) Selection • All vendors must be Active HUBs. • Provide the VID or Federal ID (do not enter SS#), HUB status (active), approximate dollar amount and/or expected percentage of the contract. • Submit copies of all Active HUBs CMBL Vendor Profiles. Note: You must repeat these steps (1 – 3) for each subcontracting opportunity.

Change it to your search need. 3. Multiple Vendor Search: Enter the “Class” and “Item” Codes – NIGP Codes found: https://cmblreg.cpa.state.tx.us/commodity_book/Numeric_index.cfm 4. Business Category/Vendor Location Search: Select any other needed fields (example: “City Location”). 5. Select Fields for Output: Select the file option (example: Excel). 6. Click “Search” Reminder: Contact Active HUB vendors to comply with the Good Faith Effort (GFE) compliance requirements.

Minority and Women Business Trade Organizations The Statewide HUB Program collaborates with various minority and women business trade organizations and development centers to circulate information pertaining to the initiatives of the Statewide HUB Program. Mentor-Protégé Program • The Mentor-Protégé Program is a voluntary program intended to foster long term relationships between Contractors and HUBs. • The Mentor will provide them professional guidance and support to facilitate their development and growth. • Utilizing a Protégé in HSP for a bid (of any state agencies and/or universities) for subcontracting counts as your good faith effort requirement and does not require contractor to perform additional solicitation for subcontracting Protégé is providing. • Your company is listed in the CPA’s Mentor-Protégé Agreement database: https://mycpa.cpa.state.tx.us/mentorprotege/ctg/menproPairs/ More information located in TAC Rule §20.298.
