  3. Undocumented Population • 11 million undocumented immigrants in the US • Increase by about 500,000 per year • 1:6 are children • 65,000 graduate from high school each year

  4. Background • 1982 – Plyler v Doe • 1986 – Leticia A. v UC Regents & CSU Board of Regents • 1991- Bradford v UC Regents • 1996 – IIRIRA Illegal Immigration Reform & Immigrant Responsibility Act

IIRIRA Section 505 • (a) IN GENERAL.—Notwithstanding any other provision of law, an alien who is not lawfully present in the United States shall not be eligible on the basis of residence within a State (or a political subdivision) for any postsecondary education benefit unless a citizen or national of the United States is eligible for such a benefit (in no less an amount, duration, and scope) without regard to whether the citizen or national is such a resident (IIRIRA, 505, 1996).
