Amendment 9 • “The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people” • People have rights not listed in the Constitution • Framers wanted to make sure the government could not deny people rights if they weren’t “listed specifically”
10th Amendment • “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people” • Reserved Powers: If it is not a right given to the national/federal government it is the right of the state
