Pengertian (Bruggink, h.159) • Teori hukum adalah suatu keseluruhan pernyataan yang saling berkaitan berkenaan dengan sistem konseptual aturan-aturan hukum dan putusan-putusan hukum, dan sistem tersebut untuk sebagian yang penting dipositifkan. (teori hukum sebagai produk). • Teori hukum sebagai proses mencurahkan perhatian kepada kegiatan teoritik tentang hukum atau pada kegiatan penelitian teoritik bidang hukum sendiri, tidak pada hasil kegiatan- kegiatan itu. • Arti tori : dapat dipandang sebagai suatu proses atau aktivitas dan sebagai produk atau hasil aktivitas itu, dan hasil itu terdiri atas suatu keseluruhan pernyataan yang saling berkaitan tentang suatu obyek tertentu.
