Board of County Commissioners Annexation Procedure for Proposed Isleworth Annexation • -- “70+% Rule” – Two Step Process: • First Step: Consent • If more than 70% of land in area proposed to be annexed is owned by individuals or entities which are not registered electors of such area, owners • of more than 50% of land in such area • must consent prior to referendum.

Board of County Commissioners • Second Step: Referendum • Single - No sooner than 30 days following final adoption of annexation ordinance, referendum for registered electors in area proposed to be annexed must be held. • Dual - Governing body of annexing municipality may submit ordinance of annexation to separate vote of registered electors of annexing municipality. • Effective date of annexation ordinance: • 10 days after annexation is approved by referendum

Board of County Commissioners Prerequisites to Annexation • Annexation Report: • Prior to commencing annexation procedures under 70+% Rule, governing body of municipality must prepare report setting forth plans to provide urban services to area to be annexed. • Not fewer than 15 days prior to commencing annexation procedure, governing body of municipality must file copy of report with Board of County Commissioners.

Board of County Commissioners • Notice to Residents and Owners: • Not less than 10 days prior to date set for first of two required public hearings on annexation ordinance, governing body of municipality must mail written notice to each person who resides or owns property within area proposed to be annexed.
