Current Authority • Pumping and Dredging Control Ordinance, Chapter 15, Article VI. • Special Districts Ordinance, Chapter 33, Articles II and IV. • Require a public hearing in order to issue a permit to alter the shoreline of any waters of the County.

Problems with Seawalls Brief History • BCC direction to discourage use of vertical seawalls. • To approve seawalls when neighbor has seawalls. • Restore lost slope by planting and rip-rap. • Promote use alternative solutions to stabilize shoreline areas.

Staff Recommendations EPD staff to issue permits for shoreline alterations when proposed activity: • Uses alternative solutions. • Vertical walls on made-made structures such as canals. • Repairs to legally existing seawalls that can be repaired or replaced in it’s exact location with rip-rap and/or plantings.
Staff Recommendations EPD Staff to issue permits when: • Applicant demonstrates the need for the use of a vertical wall and includes slope replacement (i.e. rip rap and/or plantings) and is located adjacent to an existing seawall. • Vertical wall with slope replacement and plantings when a “letter of no objection” is received from neighbor.
Staff Recommendations All other shoreline stabilization permit requests would require a public hearing.

Action Requested Authorization for the Environmental Protection Division to revise/update the Pumping and Dredging Control Ordinance, Chapter 15, Article VI, Orange County Code.
