BKK Landfill Background • Location urban: City of West Covina Owner/operator: BKK Corporation • Class I Area operated 1962-1987 (codisposal hazardous waste/MSW); closure certified 1991 • Class III Area operated 1987-1996 (MSW); partial site closure plan approved 1996; full site closure/postclosure plan approved 2002. • DTSC began emergency response action on 11/18/04 to ensure essential operations.

  3. BKK Landfill Class III Closure Status • BKK contracted out in 2004 to complete remaining closure phases and integrate with City brownfields redevelopment rough grading project. • BKK insufficient funds 9/04; closure ceased 11/04; Notice & Order issued; Revised Plans to match funding approved 2/05; FA mechanism updated. • Board options if BKK fails to complete closure. • Recent resolution with BKK, insurance company, and contractor reported for intended restart 7/05.

  4. BKK Landfill Storm Drain Repair Issue • Critical section of storm drain system failed 1/04. Progressive failure has occurred during the extreme storm season of 2004/05. • Enforcement Actions- LEA, RWQCB, and DTSC. • DTSC contractor proceeding with final repair project to be completed by next wet season; preliminary cost estimate is $3,780,000. • Initial request for funding assistance from Solid Waste Cleanup Program not currently needed.

  10. Conclusion • Adopt resolution 2005-91 to support storm drain project; provide ongoing technical assistance; and if needed potential future consideration for qualifying funding under Solid Waste Cleanup Program.
