  2. Why is it important to study law? • to be informed and thoughtful citizens • helps to make sure that the legal system continues to work

Rules vs Laws • 2 main differences between rules and laws: • rules are not enforced by courts • Eg. ‘no headgear’ rule at AVHS would not be enforced in a court of law • you can opt out of rules • Eg. if ‘no headgear’ rule was a huge issue for you, you could opt out of having to obey this rule by attending another high school

  4. The Need for Law • law provides a means for people to live in communities together peacefully • law provides predictability • law provides structure

  5. Rule of Law • Law in Canada is designed to protect rights of individual citizens • Rule of Law = principle of justice that frames Canadian law • 3 key principles of Rule of Law: • law is necessary to regulate society • law applies equally to everyone • people are not governed by arbitrary power

  6. Law & Morality • ‘morals’ = ethical motive for behavior based on concepts of ‘right’ and ‘wrong’ • Some laws are morally charged – presents challenges for society • Examples: • euthanasia • capital punishment • alcohol/tobacco vs marijuana

  7. Justice • What is ‘justice’? • 4 defining characteristics of justice: • treat all cases alike and different cases differently • law is unjust if it discriminates on basis of irrelevant characteristics • law should be impartial • law conforms to society’s values and beliefs
