  5. For legislation to be seen as democratic • It must: • Allow for wide ranging input • Part of mandate or from widely debated issue • Be subject to scrutiny

  6. Role of legislation • Enact government policy • Remedial legislation- out of date, courts • Financial • Delegated legislation

Sources of legislation • Government Party policy (Kyoto) • Pressure group activity (Workchoices -ACTU) • Public opinion/Media ( Iraq) • Public Service (OBE) • Commissions (Police corruption) • Law reform groups ( Simplify court procedures) • MPs (Daylight savings) • Committees (Stimulus Package amendments) • Courts decisions (Mabo)

  8. Good statutes must.. • Clear, comprehensive ,constitutional and still be flexible.

  9. Major Features of WA Parliament • Head of State- Constitutionally is the Governor • Does he/she have real power? Is limited, only concerned with constitutionality of laws. • Leg. Assembly- Lower house, where the executive is formed. Ie/ house of govt. • Peoples house and majority of bills and all financial bills are from here. • 59 members every 4 years • Speaker presides over house

  10. Major Features of WA Parliament • Leg.Council- 36 members • Elected every 4 years • Upper house • Represent regions • President • Executive- Majority party in LA, Premier and senior Ministers form Cabinet.

  11. Standing orders • Rules or procedures of parliament • How bills pass, maintenance of order, operation of committees, operation of debates • Who enforces? Presiding officers • Speaker in LA • President in LC

  12. Private Members Bills • Who are Private members?Mp’s without official office • What are their bills? Bills proposed by MP’s outside of the executive.

  13. Committees • Define- a small cross-party group of members of parliament that inquires into specified matters and reports back to parliament. • Can be from one house, joint house, select (temporary) or Standing (permanent) • Roles-
