Ethics Energizer #1 You are working on your Independent Review of Applicant ABC, a private manufacturing company.  Your retirement account broker, who knows you are a Baldrige Examiner,  calls you and advises you to switch some of your funds from government bonds to an aggressive growth fund containing large-cap stocks.  You wonder if this fund contains stock in Applicant ABC.  You ask your broker which stocks are included in this fund. Your applicant is listed as one of the stocks in the fund.  Can you accept your broker’s recommendation and buy into this fund? Why or why not?

  30. Ethics Energizer #1: Response Yes, you can. While the Code of Ethical Conduct requires that Examiners not have a financial interest in the applicant, you do not have control of the companies that are in this fund. They could be added or removed by the fund manager. If you are being encouraged by your broker to add stock in a specific company to your portfolio, you should generally choose not to purchase stock in the applicant because this may be perceived as a conflict of interest.
